Ted Cruz is not releasing his delegates before the GOP convention

Ted Cruz is not releasing his delegates in at least three states, a sign he may hold onto some clout at this summer's Republican National Convention.

Cruz sent a letter to Republican state parties in at least Kansas, Oklahoma and Texas on Monday informing them that he plans to keep the delegates he won bound to him...

Trump is the presumptive nominee and is on a path to clinch the 1,237 delegates needed to earn it on the first ballot, but holding on to his delegates could help Cruz exercise at least some control over convention rules and procedures.

Delegates are real people with real lives and most of them don’t want to be the center of public controversy. Their position, if it’s against the will of the voters in their state, sounds lovely until the reality hits that they have to go home and their votes and names are public information. I doubt that if they think they will be shunned at home for creating a messes in Cleveland they will most likely cave to the will of the people and not to Ted’s visions of grandeur.

Ted Cruz has no say in the matter unless he can change rule 16 at the convention.

RNC convention rule 16(a)(2) says this:


(2) For any manner of binding or allocating delegates under these rules, if a delegate (i) casts a vote for a presidential candidate at the national convention inconsistent with the delegate’s obligation under state law or state party rule, (ii) nominates or demonstrates support under Rule No. 40 for a presidential candidate other than the one to whom the delegate is bound or allocated under state law or state party rule, or (iii) fails in some other way to carry out the delegate’s affirmative duty under state law or state party rule to cast a vote at the national convention for a particular presidential candidate, the delegate shall be deemed to have concurrently resigned as a delegate and the delegate’s improper vote or nomination shall be null and void. Thereafter the secretary of the convention shall record the delegate’s vote or nomination in accordance with the delegate’s obligation under state law or state party rule. This subsection does not apply to delegates who are bound to a candidate who has withdrawn his or her candidacy, suspended or terminated his or her campaign, or publicly released his or her delegates.

This subsection is about enforcing state binding rules. It says at the top that a delegate who does not vote as the state directed them to will be discharged, and their vote will be recorded as the state initially directed.

Then it says that the subsection does not apply to delegates whose candidate suspended their campaign, meaning they will NOT be penalized for unbound voting.

Since Cruz suspended, this rule says that the penalty no longer applies. If the penalty no longer applies, then delegates bound to Cruz are free to vote for any candidate in nomination without penalty.

Cruz, by rule, no longer controls his bound delegates. His delegates cannot be punished for voting for Trump.

Cruz, by rule, no longer controls his bound delegates. His delegates cannot be punished for voting for Trump.

The devil is in the rules. Cruz is kicking up the dust just to seem relevant just like Rubio and Kasich.

I think all of you are funny. If Cruz releases his delegates and the GOPe decides to steal the nomination from Trump, like Cruz or hate Cruz, we get no conservative candidate and Hillary definitely wins.

Cruz will release his delegates to Trump. It has to be done in a way that prevents the establishment from moving against Trump.

It’s called strategery.

Well, wait a minute. Everyone for Trump is solidly behind his Art of the Deal. Well, this is exhibit A. Cruz keeps some leverage to make a better deal with the eventual nominee. The guy got second place in a field of 17 and got more delegates that the other 15 combined. He gets a seat at the table for that. Wouldn’t Trump demand the same if he were in second?
