CNN Uses Misleading Poll to Claim Most Oppose NC Bathroom Law

On Monday, CNN not only continued to misinform its viewers about the contents of the North Carolina bathroom law, but it also used a misleading CNN/ORC poll to dubiously claim that most Americans oppose the law.

New Day, CNN Newsroom, and Legal View with Ashleigh Banfield have so far cited the poll claiming that 57 percent of Americans oppose the bathroom law, but the wording of the poll gives the false impression that transgenders are required to use the public restroom of their gender at birth when, as clarified by the North Carolina governor's office, the law still allows transgenders to legally change their birth certificates with their updated gender and use the restroom of that gender.

According to the website, the text of the question read: "Overall, would you say you favor or oppose laws that require transgender individuals to use facilities that correspond to their gender at birth rather than their gender identity?"

Other polling has shown different results. A TWC survey from last month found 51 percent majority support for the law in North Carolina, while Reuters has shown nationally a plurality opposed to mixed gender public restrooms.

SurveyUSA also conducted a poll last month for WRAL which found that 55 percent of North Carolinians were opposed to allowing transgenders to use restrooms of the gender that did not correspond with their birth certificates, although there was more disapproval for other provisions of the law.

No matter what the folks at CNN might wish, it is unlikely that most Americans believe men should be granted an open-ended right to go into women's public restrooms whenever they want to.

Accounts of the law on CNN have ranged from flat-out wrongly claiming that transgenders are restricted to using public restrooms of their "birth gender," to recounting that they must use the restroom of the gender corresponding to their birth certificate without clarifying for viewers that the birth certificate can be legally changed.

At 6:13 a.m. ET, New Day co-anchor Chris Cuomo asserted that "the law forbids people from using public bathrooms that don't match the gender listed on their birth certificates," and then cited the misleading poll: "So where is the country on this? A CNN/ORC poll released just minutes ago shows what you see: 38 percent favors such laws. That means about 57 percent are opposed."

At 7:41 a.m. ET, Cuomo incorrectly claimed transgenders would be required to use the restroom of their "birth gender" as he plugged the segment: "North Carolina's governor facing a looming deadline today. Will he follow through the Justice Department's demands to reverse the state's law forcing bathroom use based on someone's birth gender"

After a commercial break, while setting up the segment, the CNN host repeated the "birth gender" claim: "North Carolina's governor is facing a big deadline today -- 5 p.m. -- to comply with the Justice Department's demand to reverse the state's controversial new law requiring individuals to use bathrooms based on their birth gender."

During the 9:00 a.m. ET hour of CNN Newsroom with Carol Costello, substitute host Pamela Brown did not clarify that birth certificates can be changed as she related: "The law requires transgender people to use the bathroom of the gender listed on their birth certificate."

She then cited the flawed poll: "A new CNN/ORC poll shows that the majority of Americans disagree with laws like North Carolina's -- 57 percent say they oppose the legislation; 38 percent support it."

At 12:30 p.m., on Legal View with Ashleigh Banfield, host Banfield also touted the flawed poll:

North Carolina's position on this law, it does not necessarily reflect public opinion because we have a new CNN/ORC poll that says 57 percent of Americans oppose this law that requires bathroom use by gender at birth. So there you go. Almost 60 percent of the folks out there across the country said, "Not in our interests, thanks so much."

That's when North Carolina's governor, Pat McCrory, that's when he has to respond to the Justice Department about the state's controversial transgender bathroom law. You can get rid of it --that's up to them -- or you can get sued for discrimination and face the loss of billions in federal funding. As you know, the law forbids people from using public bathrooms that don't match the gender listed on their birth certificates.

So where is the country on this? A CNN/ORC poll released just minutes ago shows what you see: 38 percent favors such laws. That means about 57 percent are opposed.

The governor is showing no signs of backing down.

It's not just bathroom stalls this is about. It is also about changing and showering areas.

Who wants perverts legally hanging around the Girls/Women changing rooms... except perverts?

Here's what a more accurate poll would ask:
Do you think anybody should be able to use any public bathroom they want?

That's really what these laws mean.

When most people are told about "gender identity", they probably think of Bruce Jenner, and the long process he's been through to make people think that he's a woman. But the reality of gender identity is that it can mean anything the person wants it to mean. That's the whole point. Society, or science no longer can define a gender, but the individual can create a gender identity based on their mood of the moment. And it can change, sometimes several times a day.

And appearance doesn't matter. A man does not have to be wearing woman's clothes to identify as a woman, he only needs to feel he is at that moment.

Of course, since the "gender identity" is based solely on the statement of the individual, it's not possible to prove that someone is being dishonest. So, a man who wants to watch girls go to the bathroom can just walk right in, no matter what he's wearing, and he can watch, and he cannot be stopped.

You think that's what CNN is trying to poll?

Take Bruce Jenner, or Caitlyn Jenner as he calls himself now. Just ask yourself, how can a many who fathered 6 children suddenly become a woman because he wants to.

It is not possible and anyone who thinks it is should be committed to an insane institution.

The schools are aiding and abetting the insanity: They ask young boys whether they prefer to play with boys or girls. If they answer “I prefer to play with boys,” they are signed, sealed and delivered by the school system to their parents as preferring boys to girls and needing to be treated accordingly. Insanity writ large.

I am a small contractor and I do mostly government work. Cities like Minneapolis and St Paul have their own Department of Civil Rights. They are very radical about making sure I hire minorities. That’s easier said than done. Believe it or not, some of these minorities really don’t want to work.
The last time they wanted to fine me I told them I am a left handed Norwegian. That sounded like a minority to me. They didn’t think so.

Next time I will tell them that I am a crossdresser and get discriminated against because some days I really feel like a woman. They wouldn’t discriminate against a minority like that, right? Yeah right.

Our Oregon Department of Education is delighted to endorse the initiative taken by the Federal DOJ. My letter below attempts to inject a type of thoughtful discussion into this issue I have not heard. However, I think it is really a pathetic effort in light of the Breitbart article linked to below which discusses the intent of discussions. I believe we have been here before.
In 1973 the American Psychiatric Association decided to remove homosexuality as a mental disorder from the Diagnostic and Statistical Manual (DSM). Removal followed a two year campaign Newsweek described as ongoing disruptive, chaotic attacks on psychiatrists and physiologists. Yet throughout these disruptive attacks, no academic papers arose at conferences refuting any research previously done. Eventually onslaughts forced sufficient abstentions, under-votes, and apprehensive responses for a third of APA's 17,000 plus membership to approve removal. Now states have laws against employing the highly successful therapies dealing with this mental disorder.

Oregon Transgender Policy

The Oregon Department of Education presented their policy interpretation allowing men to enter women's bathrooms and lockers rooms based on current gender feelings. This asymmetrical approach results in a random walk through reflective life. When comforting lights of popular expressions drive decisions, no opportunity remains to consider insights such that as from John Hopkins.

At one time their Sexual Behaviors Consultation Unit conducted candidates through a lengthy preparation process culminating with gender reassignment surgery. Study caused them to question whether any emotional resolution was achieved and they eliminated the practice in 1979. Dr. Paul R. McHugh says, "that transgenderism is a mental disorder that merits treatment. These policy makers and the media are doing no favors either to the public or the transgendered by treating their confusions as a right in need of defending rather than as a mental disorder that deserves understanding, treatment and prevention."

Shouldn't transgenderism first be assessed as a medical issue? Women are terribly uncomfortable with a mercurial revelation that they believe violates their inherent natural right to feel safe and private in their persons. This policy provides many the opportunities to indulge in deviant impulses. The policy thrusts a few into intimate political theater where they portray a feeble caricature of a woman, but without evidence of benefit to their psychological condition. Considering John Hopkins'; experience with reassignment surgery, shouldn't this radical transformation of society await careful review?

I really think that some people are confused with the term, “gender identity,” thinking it means that a surgical sex change has taken place instead of just “feelings.”

I wonder if the outcome of the survey would have changed if it was worded:

Do you believe individuals with male genitalia should be allowed in female restrooms (and vice-versa)?

Somehow, I think it would have.

My mother, God bless her, just received “end of life” pamphlets courtesey of Obamacare.

The wording is quite disgusting. Rather than a questions like, “Would you like to be on life support?”

The questions are worded “Would you like to be on life support even if it means you will not likely wake up, inflict serious pain on your loved ones, and take resources away from someone who needs them.”

Poll questioning is always biased.
