Supreme Court split on Obama amnesty; Kennedy: Policy ‘just upside-down’

The Supreme Court divided deeply Monday over President Obama’s deportation amnesty, with conservative justices saying the White House was trying to steal Congress’s law-making powers, and liberal justices suggesting the court should stay out of the fight altogether, leaving the president with a free hand.

Outside the court, thousands of Hispanic-rights protesters rallied, demanding legal status from the courts and vowing political retribution on Congress — and Republicans in particular — if Mr. Obama loses his case.

Inside the courtroom, however, the argument was lower-key, with the justices sparring with lawyers over the tricky interplay between the law, federal regulations and Mr. Obama’s hopes of shielding most illegal immigrants from deportation.

“It’s as if the president is setting the policy and Congress is executing it. That’s just upside-down,” said Justice Anthony M. Kennedy, who is expected to be an important voice as the court decides what to do.

It’s merely a preliminary injunction here. The lower court has not yet ruled on the merits of the case.

My opinion is SCOTUS should rule the PI should stay in place until the lower court has tried the full case. SCOTUS should not have even agreed to review the PI.

The lower court injunction will stand, no deferrment of deporation and no work visas.

Next Prez can rescind all of Obama’s America destroying Ex Orders.

Yeah, just ‘stay out of the fight’ because it’s not like the supreme court was set up to protect us against a rogue tyrannical presidency or anything-— oh wait- yes they were- they determine IF what a president is doing is constitutional or not which is SUPPOSED TO keep a rogue president from trying to violate the constitution!

PIs are taken up on appeal all of the time. If you can't show a likelihood of success on the merits--one of the bases for obtaining a PI--then it's an almost sure bet you won't succeed on the merits.

My guess is that Kennedy, Thomas, and Alito are going to vote to uphold the ruling, while the four libs are going to vote to reverse it, with Roberts voting to throw the whole thing out on the issue of standing (thus siding with the libs in effect).
