I was home alone once a few years ago and an illegal came in my back door. We are in a very rural community and the door was unlocked but my dogs were pitching a fit outside so I knew somebody was around. I grabbed the double-barrel 12-gauge and had it pointed right at him when he came through the door. He took one look at it and turned and ran. I let him go and he never came back but I suppose a red-headed female with a shotgun was more than he wanted to confront. :-)
Several years before that I was living WAY back in the mountains. A truck with two young men pulled up but my big dogs wouldn't let them out of the truck. When the Sheriff came around to check on me I mentioned it and he told me if they came back and came to the house to shoot them. He said they were bad news. I asked him about the rule that they had to actually be in the house and he said not to worry about it because if it came to that he would have his deputies drag them inside. There was no way he could have arrived before disaster any other way because I was so far back in the mountains that the property bordered the National Forest. It was on a dirt road miles from anywhere. It was so remote that I had to drive across a creek to get to the cabin and when the weather was bad and the creek was up I couldn't even get off the property unless I walked a foot-log across the creek while carrying a baby. :-) I was a 20-something with a young child living in the Appalachians and the Sheriff checked on me regularly.
Not saying I think you should ever shoot somebody fleeing but sometimes there are circumstances that even them being on your property is dangerous. Some law enforcement officials with common sense will cut a woman some slack in certain conditions since most can't defend themselves against a man, or men, any other way. You still don't shoot them in the back.
Our big problem here is the illegals working the farms in summer. Other than that, we don't have much crime.
I have forgiven her; she has saved future potential victims from this parasite.
Fleeing just means someone else will get robbed/raped/killed later in the evening...

He was seventeen, probably already had a couple rug rats. The Parents will Lawyer up and next thing you will hear is that Travon was only stealing cause he needed money to buy diapers for his youngins. And if not for the evil Republicans whom have blocked legislation for free diapers lil’ Skittles popping Trevon would still be alive to rob and thug some more.
The particulars of the case will be very important.
The homeowner can presume that a person who breaks into the home is armed and dangerous. He has no duty to determine whether or not the person is armed. So the fact that this burglar was not armed is no big deal.
The question is if the burglar was running away at the time. If it can be clearly shown that the burglar was no longer a threat, for instance if he was out the door and running away, then the homeowner would have a tough time claiming that he feared for his life. This is a pretty high bar for the prosecution to clear, however.
