Court rules N.Y. attorney general's Trump University fraud lawsuit can proceed

Super Tuesday has gotten off to a not-so-super start for Donald Trump - a state appeals court has denied his bid to toss out a lawsuit that charges his Trump University was a fraud.

In a unanimous ruling, a four judge panel of the state Appellate Division said the state Attorney General's office is "authorized to bring a cause of action for fraud" - despite the billionaire's claims to the contrary.

Lawyers for Trump and his now-defunct school had contended that Attorney General Eric Schneiderman's suit should be tossed because the statute of limitations on the case had expired.

Schneiderman charged Trump University, which operated between 2004 and 2010, was a sham that ripped off students, beginning with a "free" seminar.

The suit said "although Trump University speakers represented that the three-day seminar would teach students all they needed to know to be successful real estate investors, the instructors at those three-day seminars then engaged in a 'bait and switch,' telling students that they needed to attend yet another seminar for an additional $5,000 in order to learn more about particular lenders."

The AG's suit charged that through "their deceptive and unlawful practices, (Trump and school) intentionally misled over 5,000 individuals nationwide, including over 600 New Yorkers, into paying as much as $35,000 each to participate in live seminars and mentorship programs with the promise of learning Donald Trump's real estate investing techniques."

It also charged they "repeatedly deceived students into thinking that they were attending a legally chartered 'university'" and "intentionally misrepresented, through advertisements and oral misrepresentations, that prospective students would be taught by successful real estate 'experts' who were 'handpicked' by Mr. Trump when, as alleged by petitioner, not a single instructor was actually handpicked by Mr. Trump, not a single instructor was actually handpicked by Mr. Trump."

This last suit was filed long before Trump ever started running for president. If your kid or perhaps your elderly parent had lost money attending Trump University would you be so cavalier about this lawsuit? Correct me if I’m wrong but both the plaintiffs and the defendant agree that large sums of money were given to Trump University. That fact is not in dispute.

But, they are drooling now..how could one lose money from a place that sells information about doing real estate? I just do not buy it. What they are really saying is they were not happy for what they voluntarily signed up for. Wouldn’t it be something if one could sue the real University’s at will for not providing the education the plaintiffs felt they should get...I think the largest amount I have read is $36,000...not a large sum by any means but large enough that one can reasonably assume that the “buyer” did some due diligence to determine whether or not to purchase those services. It isn’t like they paid and there was no classes or seminars...I don’t think that is the claim. Their claim is that the information given them didn’t make them rich basically.

The details of the lawsuit should give us a hint as to what was really being promised for the tuition they were paying.

According to the complaint filed in San Diego federal court, they were encouraged to sign up for more expensive levels of instruction, which were to include personal mentoring by experts “handpicked” by Trump. But instead, they say, the seminars were more like infomercials.

So, this is not a mere 3-day seminar but a promised ON-GOING coaching.

The lawsuit alleges that the for-profit university’s promises that advanced students could make tens of thousands of dollars each month were bogus, and that the school instead left many in debt.

Trump has argued that he can’t be held personally liable because he didn’t run daily operations at the university, although he says he did handpick the instructors. He also disagreed with allegations that the program was worthless.

He also says he can’t be held liable for the INEPTITUDE of the students.

In the New York Lawsuit, the people who sued were told that they would meet Trump during seminars but instead got a picture on a life-size cardboard cutout.

While consumers were encouraged to call their credit card companies during breaks to increase their credit limits to have access to funds to do real estate deals, the real reason Trump University asked consumers to request higher credit limits was so they could use the credit to pay for the expensive Elite programs, which the lawsuit claims did no guidance or mentoring at all.

Well, that’s the complaint in a nutshell.

Yeah, that's why a piddly lawsuit has been fast tracked and publicized extensively. Look it doesn't take a genius to figure this stuff out. You know that this wouldn't even be news if Trump wasn't winning. There was a full money back guarantee that I understand 40% took advantage of. It proves nothing and it makes no difference.

What Fraud?

I don’t know about where you live but these seminars come around several times a year, TV and radio both advertise them.

Toothpaste commercials advertise how they will get rid of cavities, they won’t unless you go through a lot of trouble to brush several times a day and use the right mouthwash and don’t drink soft drink and stay away from sugar. If you are so stupid as to believe what advertisers say then you deserve to be separated from your money.

The lawsuit itself PRECEDED the announcement to run, therefore, whether losing money is the fault of the plaintiffs or not, it not likely that is was filed with a political motive.

I will concede that those who want to bring Trump down will USE this lawsuit politically. Rubio has been using it in his campaign ( and even in the Texas debate ).

Oh, I think this would STILL be news even if Trump did not run for President. His name is too famous for the press to ignore.

However, it will not be AS BIG a news as it is today ( and in the months to come ).

Yeah Don is in a pickle. He can settle and look like a fraud that got caught. Or he can do the Bill Clinton and testify and get caught in a perjury charge or admit on the stand he scammed people and that in reality he knew he was lieing in the ads for Trump U.

It will be interesting to see how it plays out.

I meant to put “witch hunt” in quotes.

I was there in Westlake park in the early 90’s when Hillary came with her health care nonsense. I was one of the very few conservatives that was able to get inner part of the crowd reserved for her supporters. I rolled up one of her “give ‘em health care, hillary” posters as a bullhorn and yelled “thanks mom” whenever she offered to give stuff. I caught her eye. You can actually see it on the youtube video of her speech.

The woman nauseates me. It is an embarrassment to our country that she has any support whatsoever.

Just to be clear. :-)

Trump had a good acceptance speech and press conference. Fox Business Channel had all their business experts on. For me that is more worthwhile than the political pundits.
