Trump supporters file 'birther' lawsuit against Cruz in federal court

Donald Trump supporters have filed a lawsuit challenging the eligibility of one of his primary rivals, Sen. Ted Cruz (R-Texas), to run for president.

The lawsuit, filed Feb. 3 at a district court in Alabama, seeks a judgment "declaring that Rafael Edward Cruz is ineligible to qualify/run/seek and be elected to the Office of the President of the United States of America" due to his Canadian birth. Cruz was born in Calgary, Canada, to an American mother.

The five plaintiffs — Sebastian Green, Shannon Duncan, Kathryn Spears, Kyle Spears and Jerry Parker — are all backing Trump in the Republican primary, according to AL.com.

I’m sure this suit will not be heard due to “lack of standing” but the dems will find a way around that when the time is right.

it didn’t work on obozo but since Ted Cruz is pro-Constitution, not black nor a democrat, imho, he’ll more than likely be disqualified.

Now that we're talking about republicans ... I wonder if unlike Alan Keyes, ripeness in both Trump's timing and standing will both found by the courts ... We knew this was coming. And if Cruz had a single member on his staff reading birther posts (mine) on this forum, he would have known how to establish cover for this eventuality. But, he apparently does not, and it will be very interesting now, after the fact, to see how Cruz manages this.

Soooooo .. is this the reason Trump just declared yesterday or today, that he is not going to attack Cruz anymore ..??

Or .. is Trump funding this .. just to get it out of the way .. so he can choose Cruz to run with him ..?????

Trump is so wishy-washy .. I have a hard time figuring out what he’s going to do.

I’m not happy about this .. but the Trump-bots on FR are going to be more of a pain the neck than usual .. I suggest we ignore them .. they don’t deserve to be credible.

Ted Cruz Is A 'Natural Born Citizen,' Board Of Election Finds
"Further discussion on this issue is unnecessary."

"The Candidate is a natural born citizen by virtue of being born in Canada to his mother who was a U.S. citizen at the time of his birth," the board said, reasoning that Cruz met the criteria because he "did not have to take any steps or go through a naturalization process at some point after birth."

Both objections, which on their face seemed to carry little weight, had forced lawyers for Cruz to formally respond and offer appropriate counterarguments.

In response to the filings, Cruz's lawyers relied on Supreme Court precedent, legal history and articles from noted constitutional scholars to defend the view that he is in fact "natural born" within the meaning of the Constitution.

The lawyers also pointed to the valid candidacies of two former Republican hopefuls, Sen. John McCain of Arizona and former Michigan Gov. George Romney, as examples of presidential runs that received the blessing of Congress, courts and other means to proceed, despite the fact that both men were born abroad and raised eligibility questions.

These and other sources of authority, the lawyers said, "all command the same conclusion" that Cruz complies with the "natural born" requirement.

Keep the lawsuits coming... the more places that validate Cruz the better.

Why would a voter who wants to cast a vote for a legal candidate not have standing?

To have standing, you have to be able to articulate an injury that you will suffer that is distinct from a generalized claim of injury to the public at large. In other words, you have to be able to show how you are injured in a way that is different from the general public.

FACT: He would not have sealed his records if he had nothing to hide.

Actually, you are right... the rules on standing apply only to Obama. Cruz will most likely will get a different type of treatment in the courts and in the media. This may go somewhere.

Cruz should spend his energy for the next 4 years getting it settled, or get a waiver, and then, only then should he put himself up as a candidate, for now he is just wasting time, money and votes.

Its not his time. Maybe next time, 4 years isn’t eternity.

I think the reason Trump brought this up to begin with was he was thinking of having Cruz as his V.P.;

The Washington Post reporter asked him about whether Cruz was NBC and Trump didn't know, so he said Cruz needed to clear this up...Cruz sealed his records and hasn't done anything about it...

You have to be born on American Soil to be President or V.P. so we should get this out in the open, if Cruz has the legal paper his Mother should have filed for him, then bring it out and show us, I don't think he does, or he would have had this birther settled right after Trump said what he did, and apparently this Washington Reporter knows something or he wouldn't have brought it to light...IMHO...
