Birth of U.S. Citizens Abroad
A child born abroad to a U.S. citizen parent or parents may acquire U.S. citizenship at birth if certain statutory requirements are met. The childâs parents should contact the nearest U.S. embassy or consulate to apply for a Consular Report of Birth Abroad of a Citizen of the United States of America (CRBA) to document that the child is a U.S. citizen. If the U.S. embassy or consulate determines that the child acquired U.S. citizenship at birth, a consular officer will approve the CRBA application and the Department of State will issue a CRBA, also called a Form FS-240, in the childâs name.
According to U.S. law, a CRBA is proof of U.S. citizenship and may be used to obtain a U.S. passport and register for school, among other purposes.
The childâs parents may choose to apply for a U.S. passport for the child at the same time that they apply for a CRBA. Parents may also choose to apply only for a U.S. passport for the child. Like a CRBA, a full validity, unexpired U.S. passport is proof of U.S. citizenship.
Parents of a child born abroad to a U.S. citizen or citizens should apply for a CRBA and/or a U.S. passport for the child as soon as possible. Failure to promptly document a child who meets the statutory requirements for acquiring U.S. citizenship at birth may cause problems for the parents and the child when attempting to establish the childâs U.S. citizenship and eligibility for the rights and benefits of U.S. citizenship, including entry into the United States. By law, U.S. citizens, including dual nationals, must use a U.S. passport to enter and leave the United States.

But, it looked like a fake. This diversion has become very effective for Trump. I like Cruz. I like Trump. This is a cagey political move.

Well you can sit and b!tch about people on FR bringing it up, and think that simple shaming is sufficient to brush it off.
But the thing you guys need to be asking yourself is if these guys are bringing this up, how much of it is already loaded up by the Democrats, and ready to fire? Or having control of the executive branch, how much MORE may they have.
It isn’t logical to have had most people on FR knocking Obama for 8 years over this same issue, but then you demand that a similar issue with Cruz be swept under the rug because it’s inconvenient.
If Cruz were ever to be the nominee or even VP, this is going to be an issue, and it will be pushed by the left and the media, and they aren’t going to care what people on FR, or 10,000 conservative bloggers (that think an opinion piece is as good as a court ruling) think about it.
The person may have just signed up, but the valid question is raised, the same feeling many of us had about just maybe Obama being born in Kenya to an American mother. The paper trail IS important if we want to be a people of THE LAW. Liberal courts ARE capable of making this issue a real threat to the voice of the majority.
Kabar and I had a rather heated exchange where he and I were on opposite sides of that question, or some form of that question, and I would like kabar to respectfully reconsider his position that Cruz's citizenship depends on a CRBA or a Certificate of Citizenship.
My point of view is that Cruz is a citizen because the circumstances of his birth meet the relevant statute. There is good evidence that his mother was a citizen at the time of his birth, and that she met the residence requirements in the statutes before Ted's birth abroad. Ted has traveled on a US passport, which is only granted to US citizens.
The new argument that I offer is to ask what a court would find, if, hypothetically, there is no CRBA (and even no passport). I think the court would examine the evidence associated with the circumstances of birth, and perform the same analytical function that a Consulate Officer performs. If the evidence substantiates Cruz's mother's US citizenship at Cruz's birth, and her residence in the US before his birth, the court would find Cruz to be a citizen at birth, pursuant to the relevant statute. It would do so even if there was no CRBA, no passport and no Certificate of Citizenship.
Just more Trump innuendo. He's good at stuff like that.
The only time naturalized or other legal created citizenship would apply to presidential qualifications was at the time of adoption of the US Constitution as it says in black and white.
The Clause at issue is this one please note it distinguishes natural born citizen from citizen.
âNo person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President;...â
The only time a legal-created citizenship mattered for president was â... at the time of the Adoption of this Constitution,â and this aint 1776 no more.

Find out what were the school registration rules in Texas in 1976/77 when he started kindergarten.
Most importantly, Ted went to England for a competition when he was high school age; that would have been between 1985 to 1988.
He would have needed a passport to travel.
