NH rejects efforts to keep Trump, Sanders off ballot (and Cruz & Rubio)

A New Hampshire agency has rejected efforts to keep four presidential candidates off the ballot.

The New Hampshire Ballot Commission upheld New Hampshire Secretary of State Bill Gardner's decision to allow Sen. Bernie Sanders (I-Vt.) on the Democratic primary ballot and Sens. Ted Cruz (R-Texas) and Marco Rubio (R-Fla.), as well as real estate mogul Donald Trump on the GOP primary ballot. Commission Chairman Bradford Cook said all decisions were unanimous.

The decision on Sanders came in response to a complaint that argued was he was ineligible to run as a Democrat because he was elected and currently serves as an Independent.

Sanders's campaign praised the decision to allow him on the Democratic ballot.

"The commission's ruling today ensures Bernie's name will be on the New Hampshire ballot, and puts this issue to bed for good," Sanders's New Hampshire state director, Julia Barnes, said in a statement.

Cook said that Andy Martin, who filed the Sanders complaint, has already sent an appeal to the New Hampshire Supreme Court, but explained that the commission's decisions can't be appealed.

"From a statutory point of view, our decisions are final and can't be appealed," Cook said.

Former New Hampshire GOP Chairman Fergus Cullen filed a complaint against Trump, arguing that the real estate mogul isn't aligned with the Republican Party's values. But the commission quickly dismissed the challenge and voted for Trump to appear on the GOP ballot.

"The Trump thing was, no pun intended, trumped up," Cook said.

Two complaints were filed against Cruz. The first one challenged whether the GOP presidential hopeful was a "natural born citizen" -- a constitutional requirement to run for president -- citing that he was born in Calgary, Canada.

The second alleged that Cruz and Rubio didn't have at least one parent who was a U.S. citizen. Rubio's parents were born in Cuba and immigrated to the United States in 1956. The commission dismissed both complaints and voted to allow those candidates to be placed on the GOP ballot.

Trump leads the GOP field in the early-voting state, ahead of his rivals by nearly 15 points , according to the RealClearPolitics average of polls. Rubio and Cruz are in second and third place, respectively.

Sanders trails former Secretary of State Hillary Clinton in New Hampshire by 4.3 points, according to the RCP average.

The National GOP operatives better wake up. The average GOP State party activists are pretty fed up with these attempts to manage the process from DC. They are going to get a LOT more push back in 2016 then they did in 2008 and 2012

DC would be wise to get out of the way before they get run over.

Oh oh. Well Curz fans, it's not just Trump the GOPe has it's sights set on. And with Rubio in there, who is Left? Why Jebra...

This should wake some folks up who only yesterday were saying the GOPe couldn't stop the campaigns from playing dirty.

There needs to be some pushback on this. The GOPe needs to know it's very survival is on the line, and if it can't control it's fellow travelers, the party is done.

Rubio's parents did not become naturalized United States Citizens until 4 years after his birth in Miami.

The leadership of the Republican Party and the RNC is also complicit in this usurpation of the founders and framers intent with the eligiblity clause in Article II Section 1. The Republican Party leadership has ENABLED Obama to get away with what he has done to illegally usurp national power in order that the Republican Party can do the same thing too, i.e., ignore the Constitution when it suits their own political power objectives. It is time for a change in the Republican Party leadership.. A major change.

Factually incorrect on Canadian born Rafael Edward Cruz.

His mother was a US Citizen by birth.
Rafael his father was a Cuban citizen until he naturalized in 2005.
35 years after Ted was born.

Marco Rubio's parents were both Cuban citizens until they naturalized Nov 5, 1975.
4.5 years after Rubio was born.

Oh, did Sanders register as a Democrat? I keep seeing him shown as an (I-VT).

If he didn’t, good luck on that court case. Election law in NH is specific - you can not run for a party’s nomination without being a registered member of that party.
