Obama May Bypass Congress, Impose 'Order' For Gun Background Checks

President Barack Obama is considering using an executive order to impose new background-check requirements on people buying guns from high-volume dealers, The Washington Post reports.

The change would require dealers who go over a certain number of sales per year to have a license from the Bureau of Alcohol, Tobacco, Firearms and Explosives and do background checks people attempting to buy guns from them.

NBC News reported Friday that the administration has considered 50 or 100 guns a year as the threshold to trigger these requirements, although there's been on final decision.

"This is a super-complicated policy," an administration official familiar with the idea told NBC.

The ATF objects to the action, saying it would be difficult to enforce, and one official told the paper, "Everyone realized it would be hugely politically controversial."

I remember the Greek riots around their government building last year and this summer and thought, these are children throwing a temper tantrum! They clearly out numbered the police forces 10 to 1, yet all they did was scream obscenities and throw things. They could have easily overrun the authorities taking only light casualties, but because they were angry and not really organized they made noise and nothing more! They really have not the courage of their convictions! One million men show up out side the capital building and there would be no stopping them if they were willing to take casualties. They could set up trials and start the hangings right there on the capitol grounds. So fi your unwilling to take one for the team, ‘Shut Up’

Does it matter how it’ll play out in court? He’s a tyrant and he’s already demonstrated that he’ll ignore the courts - all of them, and our Republican leaders stand by, wring their hands and say, “What can we do...?”

I don’t get it. All transfers from an FFL have to have a background check already, regardless of the volume of business they do.

llow me to entertain you with a story about my experiences with the GOP-e in New York state. Let's get into the WayBack machine, and travel to the 1990's. The Federal Assault Weapon Ban was passed, and an election for Governor was nigh. I joined a group called "Sportsmen For Pataki", because unseating Cuomo was a high priority. Cuomo vowed to make a state law banning 'assault weapons' that mirrored the Federal law. Pataki came out against it in his campaign. We had misgivings about Pataki, because he had some liberal markers, but we took him at his word on the ban. He unseated Cuomo. A few years later, in 2000, he 'evolved' on the issue of gun control, and he backed an assault weapons ban. He twisted the arms of Republican state representatives' to vote FOR an 'assault weapon' ban that he personally backed. Cuomo wouldn't have been able to twist those arms, but Pataki, in control of the state Republican machinery -- and the money -- could. And he did. And it passed.

What this informed me is that a liberal Republican can do much more damage than a liberal Democrat.

If you back a liberal Republican, you are actually backing the worst of two choices.

They're calling anyone that sells a firearm a dealer whether they are licensed or not.

It’s super complicated because the GCA68 Fed law says if you buy and sell firearms as a business you have to have an FFL. If you buy and sell firearms to enhance your “collection” you don’t. So it’s complicated for the executive branch to go against the law as it is written by congress.

And this will not do anything to them. The regulation he's looking at putting out is defining who needs to have that license, and would only affect some people who are kinda dealers, but not enough so that ATF requires them to have a FFL. The agency currently determines what constitutes a firearms business, and who is required to have a FFL. People with less business can still get one. All Obama is doing is trying to set a definition of what constitutes the lower limit of sales for a business that is required to have a FFL.

And yes, 50-100 is a decent bit of business and likely is already covered by ATF regs. My guess is that was just a sound bite and if he goes forward with this the number's gonna be a lot lower.

Yes, and they already have an FFL and are required to do background checks. This wouldn't apply to them.

Also, as soon as Obama (BATF) tries to classify “gun collectors” as dealers based upon an arbitrary number of sales then you can bet the NRA will have them in court.

Not to worry. They won't go after the little guys like us. They'll just crack down on the High Volume Ammo Purchasers, defined as those who buy 5 or more rounds of ammo per lifetime.

I don’t know how EO’S interfering with interstate commerce would work. I thought under congress had the sole authority. But I grew up in a different time.

Curiously, we are on the wrong side in that war.

I grant you Romney would not have advanced Islamic interests, but that's over there, and Romney could have done much more damage locally.
