KIM DAVIS FACES NEW CHARGES OF NON-COMPLIANCE

Kim Davis, the Rowan County, Kentucky, clerk who spent five days in jail for refusing to issue marriage licenses to same-sex couples in compliance with a judge’s order – and who resumed work a few days ago – is still not doing her court-ordered job, say couples who’ve tried to get their proper wedding documentation.

And they’ve taken their case back to court, saying Davis needs to fully comply or face fines.

Reuters reported Davis is issuing forms that contain material changes, not the original, official ones. Specifically, she’s taken the documents pertaining to marriage licenses and removed the references to Rowan County and her clerk’s office. “Gay” couples seeking marriages are instead given forms that list deputy clerk Brian Mason – the entity who issued the licenses during Davis’s jail time – as a notary public.

But “gay” couples say: that substitution won’t suffice. They’re charging Davis is still violating U.S. District Judge David Bunning’s order, particularly the part where he said she could leave jail, but only on the condition she not interfere with the issuance of marriage licenses any more.

Lawyers representing the “gay” couples have filed a motion in court, alleging Davis is non-compliant with a federal order, Reuters reported. Attorneys with the American Civil Liberties Union of Kentucky say the documents for “gay”-marriage licenses should either be the old style, with the proper office reference, or the clerk’s office should be fined.

Mat Staver, the attorney for Davis, said the new filing is little more than a witch hunt.

“The ACLU’s motion to again hold Kim Davis in contempt reveals that their interest is not the license but rather a marriage license bearing the name of Kim Davis,” he said, Reuters reported. “They want her scalp to hang on the wall as a trophy.”

But none of that is her problem, is it? The Federal Judge directed her office to violate the law by issuing signatureless licenses. Since she was in jail she couldn’t contravene his order to her staff. And he ordered her not to contravene his orders under penalty of going back to jail.

He even said that there’d be doubt as to the licenses validity, and the risk was all on the couples who still chose to seek them.

She’s now engaging in a textbook case of malicious obedience.

The Judge may indeed be full of it. But he’s also created a situation that illustrates the absurdity of it all, AND sets it up to be a major issue in the elections next Month.

Signature OR name. She objects to her name appearing on the form, but Kentucky statutes say the form must bear a statement that the clerk (and only the clerk) authorizes the union of the named couple in marriage. (402.100(1)(a), if I recall correctly)

The deputy clerks have been able to sign/witness that the form was issued, and that the completed form was recorded. But the deputy clerks don't have the statutory authority to authorize the marriage.

Judge Bunning has had the Kentucky statutes in front of him, and plenty of time to study them. It's up to him to issue a clear order, and if he decides that he's going to order a violation of legally-recognized conscience, well, then he's screwed up (again), as a matter of law.

Gay marriage is NOT Federal law. It is simply not, any more than the sky is pink. The 10th Amendment reserves to the States, and to the People, EVERYTHING not expressly delegated to the Fed.gov. Marriage is NOWHERE in the Constitution, so it was NOT given to the Fed.gov. Therefore the Fed.gov has NOTHING to say about it, and the Extreme Court can go sit on a coke bottle and rotate. Q.E.D.

If obama is not enforcing the “ Law of the land” on immigration, will the ACLU take him to court for contempt? Why not? How about “Sanctuary Cities” Are these mayors going to jail for not enforcing “The law of the Land” ? Since when did we start putting public officials in jail if they don't enforce “the law of the land”? This seems to me to be unequal protection of the laws and a violation of her 1st amendment rights.

Just out of idle curiosity, has Kentucky made a marriage law that is in compliance with the SCOTUS decision? Or are all marriages still unconstitutional in the state as they’ve failed to write a compliant law?

The answer is NO.

Kim Davis assumed office under the Kentucky Marriage law that among others, PROHIBITS same-sex marriage and that is still law today. She did not expect the Supreme Court to make such a decision when she ran for office.

The law could be changed by an act of legislation but the legislature does not re-convene until January next year.

What is theoretically unconstitutional is the portion of the law prohibiting same-sex marriage. That’s all.
