Kim Davis, the Rowan County, Kentucky, clerk who spent five days in jail for refusing to issue marriage licenses to same-sex couples in compliance with a judges order and who resumed work a few days ago is still not doing her court-ordered job, say couples whove tried to get their proper wedding documentation.
And theyve taken their case back to court, saying Davis needs to fully comply or face fines.
Reuters reported Davis is issuing forms that contain material changes, not the original, official ones. Specifically, shes taken the documents pertaining to marriage licenses and removed the references to Rowan County and her clerks office. Gay couples seeking marriages are instead given forms that list deputy clerk Brian Mason the entity who issued the licenses during Daviss jail time as a notary public.
But gay couples say: that substitution wont suffice. Theyre charging Davis is still violating U.S. District Judge David Bunnings order, particularly the part where he said she could leave jail, but only on the condition she not interfere with the issuance of marriage licenses any more.
Lawyers representing the gay couples have filed a motion in court, alleging Davis is non-compliant with a federal order, Reuters reported. Attorneys with the American Civil Liberties Union of Kentucky say the documents for gay-marriage licenses should either be the old style, with the proper office reference, or the clerks office should be fined.
Mat Staver, the attorney for Davis, said the new filing is little more than a witch hunt.
The ACLUs motion to again hold Kim Davis in contempt reveals that their interest is not the license but rather a marriage license bearing the name of Kim Davis, he said, Reuters reported. They want her scalp to hang on the wall as a trophy.

Let me see if I understand. A marriage license issued by the deputy clerk and without her authorization, while she is in jail is valid. One issued by the deputy clerk without her name on it is not valid.

They are giving her exactly what she wants....publicity. She’s playing them like a fiddle.
The goal is to eliminate Christianity. She is but one of the first. There will be more.

That’s the point, many are claiming that it isn’t valid.
The validity is still in question.
There needs to be legislation or absent that, an executive order from the governor, changing the way marriage licenses are issued since the Supreme Court’s decision has changed the way things are being handles in Kentucky ( Prohibition of Same-sex marriage is STILL the law in Kentucky and no legislation has been passed to change that ).

This is about getting HER signature onto those documents. Nothing else. It’s not enough that they have licenses certified as valid per the ruling of a Federal Judge (and are asking him to directly contradict his earlier ruling) they want their ounce of blood and to add insult to injury. Because being able to marry isn’t enough, they need to rub the losers face in the ground in order to be satisfied.
Of interest is that they’re claiming a “two tier” system. So long as the Clerks office is issuing the same exact, revised and signatureless, licenses to Heterosexual couples, that argument should be thrown outvas specious.

Hey, let’s save Kentucky money by permanently closing their legislature and let guys like Bunning do all the legislating for us.
They’re also giving the KY GOP and Matt Bevins what they want.
State elections are in a little over a month. This may kick the major statewide offices and state house of reps over to the GOP.
The “arrested for being a Christian” optic is pretty persuasive to a lot of people.
There is a tagline in there somewhere.
I think the judge is full of it. The marriage licenses he approved of are not valid.
The form shall provide for the entering of “The date and place the license is issued, and the signature of the county clerk or deputy clerk issuing the license.” KRS 402.100(1)(c)
KRS 402.110 Marriage license to be uniform and completely filled out. - The form of marriage license prescribed in KRS 402.100 shall be uniform throughout this state, and every license blank shall contain the identical words and figures provided in the form prescribed by that section.
Rowan County is not the name of the Rowan County County Clerk. Listing Rowan County as the name of the County Clerk is a violation KRS 402.100(1)(c), 402.110. Yet somehow hizzoner saw no problem with these licenses.
