There is surveillance video of him pumping gas, there were witnesses. That's the stupidest defense ever.

Almost certainly BS, however, what is he trying to say? Was the perp hired by his wife to take him out? Or it was OK to shoot him because he was going to have an affair? That is the defense? Don’t get it.

Gag order needs to be put into effect immediately. This is poisoning the well for jury selection. Deputy Goforth was in uniform, pumping gas into a patrol car when executed, which can be argued are actions more in line with his job’s duties than not. There was no connection between accused and either the deputy or woman claiming the affair so crime of passion is out. No where else to go but blame the victim.

I saw this defense lawyer on the news last night. He looks kinda cross eyed, sounded that way too.

So what if Goforth was having an affair, unless the wife hired the killer to off her cheating husband. The lawyer didn't hint that, he just hinted that if he was meeting the woman he could not have been on duty.

This murder has gotten more air time on our local stations than anything I have seen in years.

This is immaterial to the case. An officer on duty is not prohibited from talking to someone he knows, even if that is not directly related to his duties. Even more so if it is in a public place.

Periodically, officers take breaks during the course of the day, for things like lunch, coffee, restroom, etc. But they are still on duty during those times, just excused from taking active calls, unless they are emergencies.
