Attorney For Kim Davis: Clerks Issuing Gay Marriage Licenses are the Ones Breaking the Law [VIDEO]

As Kim Davis was released from jail today, she stood outside with Gov. Mike Huckabee and her attorney Matt Staver as they answered a few questions from the press. During the impromptu presser, Staver claimed that it is not Kim Davis who broke the law, but rather the clerks issuing licenses in her absence.

Davis, through Staver, has taken the position that all the licenses issued since her refusal are invalid under the law, and that furthermore, she would have been breaking the law if she had issued them absent any direction from state lawmakers in Kentucky:

I disagree. The license calls for her signature or the signature of a deputy.

I pray that Kim Davis has the strength to carry on in her fight against judicial tyranny and their unjust “laws.”

I understood the deputies were forging (rubber stamping) Mrs. Davis’ signature. In any event, the first order of business Kim Davis should take as she resumes her job should be to fire her deputies.

Except her son.

Possibly, but Kentucky law states that same sex marriage doesn’t go into effect until January 1, 2016. So, if she issued and signed licenses BEFORE then, she would have been breaking state law.

That is the part which the MSM isn’t telling anyone! It is also why this whole thing SHOULD blow up in the Federal Judge’s face! She was held in contempt of court for following the law, as it is written. How is that even possible?!?

The Judge did not have the authority to tell a STATE position to not follow STATE law!

I see your point, but her refusal as Clerk also invalidates her deputies.
“The licenses that were issued were issued without the authority of the clerk of Rowan County and they are not valid,” says Staver. “There are criminal law in Kentucky that say if you issue a license to someone that is not authorized by statute, that there are criminal penalties for that.”

I believe I read that the deputy’s signature has to be “authorized” by the county clerk. Kim Davis has not authorized the issuing of licenses to homoxexual couples.

Second order of business, to hire a devout Muslim as her deputy, and delegate to him/her all duties for issuing of licenses. If they are issued, no harm to the Christian faith. If they are not, hoo boy, let the liberal heads explode when the Muslim gets hauled before Judge Bunning.

I read the statue. Her or a deputy. There is no stipulation that they need her permission.

The license also calls for a statement from the clerk that the marriage is authorized under her (in this case) authority. Further, it appears that the license has been altered to put "Rowan County" in the spot where Davis's name is required to be. KY law forbids this alteration, as well.

SCOTUS struck down Ky’s marriage laws as well as other States that do go along with fag “marriage”.

They have no laws to be broken!

She should sue all her deputies in court for malfeasance and drag that effing Federal Judge into State Court to answer for his illegal acts along with the US Marshals who carried out his order.

Except her signature that appears on the cert for authorization.....which was her objection to begin with.

The only laws that are being broken are those in KY. SCOTUS does not LEGISLATE, or issue LAWS. Their charter is to review existing laws.

I don’t see any allowance for the liscense to be issued by a deputy clerk.

402.080 Marriage license required — Who may issue.

No marriage shall be solemnized without a license therefor. The license shall be issued by the clerk of the county in which the female resides at the time, unless the female is eighteen (18) years of age or over or a widow, and the license is issued on her application in person or by writing signed by her, in which case it may be issued by any county clerk.
