Beshear reacts to Rowan County marriage license issue

FRANKFORT, Ky. (WBKO) -- Gov. Steve Beshear’s Statement on Marriage Licenses in Rowan County:

“Judge Bunning’s decision today speaks for itself. The future of the Rowan County Clerk continues to be a matter between her and the courts. Deputy clerks have said they will commence issuing marriage licensesbeginning tomorrow. It appears that the citizens of Rowan County will now have access to all the services from the clerk’s office to which they are entitled.

Again, the legislature has placed the authority to issue marriage licenses squarely on county clerks by statute, and I have no legal authority to relieve them of their statutory duty by executive order.

The General Assembly will convene in just four months and can make any statutory changes it deems necessary at that time. I see no need to spend hundreds of thousands of dollars of taxpayers’ money calling a special session of the General Assembly when 117 of 120 county clerks are doing their jobs.” – Gov. Translation: Since Kim Davis is sitting in jail for refusing to give marriage licenses to homo's, NO MARRIAGE LICENSES may be issued. Deputy Clerks can only issue marriage licenses with the permission of the County Clerk, Kim Davis.

Permission which she has NOT given.

There does not have to be a marriage law exclusively for gays.

The Supremes merely changed the interpretation of the existing laws. Based on the equal protection clauses. Therefore, if there is a marriage statute it applies to any two unrelated people considered adults.

Now, I don’t think ANY state should be involved in the marriage business. Marriage is a union based on religious standards. But, if you are going to have one...it’s got to include gays.

Accepting a pardon is an admittance of guilt.

Anyway, she hasn’t been charged with anything. She has simply pissed off the judge. And a Federal judge at that. They don’t take well to being ignored.

Many states used the terms “husband” and “wife” on their forms and in their laws. So, this harmless “interpretation” that you support did require changes to legal documents.

An “interpretation” that changes the legal definition of terms found in a law is a change in the law.

The state legislatures could change this situation very quickly by changing its law so that county clerks are not *required* to issue marriage licenses.

She already tried to not give out any licenses at all, and if that was allowed by the state, the federal judge would get no say in the matter.

Yes, that was a point raised immediately after the ruling and Beshear refused to call the legislature into session to address it. He is at fault for this conflict - it did not have to occur. The leaders of both House and Senate (including the Democrat House Speaker, who is an ultra liberal) pleaded with the Governor to call a short session so they could address this before things got out of hand as they feared - which it did, and he’s at fault for it as he could have prevented it from starting in the first place, or stopped it from occurring.

I am not arguing the fine points.

I am simply explaining that if a state has a marriage law it cannot refuse it to gays.

The woman can use whatever excuse she wants. But she is going to stay in jail until she resigns or changes her ways.

Actually the problem here is that the federal government has no jurisdiction in this matter...

No Federal law is being violated. The Federal government does not require a state to issue marriage licenses, nor does it have the authority to do so. She is not a Federal employee. This is about an arrogant judge with a god-complex. He has incarcerated her for not obeying his orders. But what are the basis of his orders? Not violation of laws mind you, but she as the temerity to defy him. Does she knot know who he is? He thinks he is the law, not a man under the law. If she will not issue a license to same sex deviants he might under the ruling of the USSC and the equal protection clause issue an injunction against issuing any licenses for marriage. If you will not bake the cake for the fags then you will not bake cakes for anyone sort of logic.

I think she should resign, but there's no reason she MUST resign and there's no compelling reason for a Federal judge to put her in jail.

The longer she stays in jail, the more outrageous the whole case becomes. You cannot have a Federal judge putting a harmless county clerk in jail without any criminal charges or trial by her peers while the same Federal government encourages foreign invaders to pour into this country in open violation of Federal immigration laws.

I would probably be more outraged if I took anything this country has to offer seriously anymore, but I don't.

you got it right. They are starting with any individual Christians they can target and destroy. They move to the public churches after that and destroy those. When the remaining Christians are meeting in secret, then they will be done, Islamic State of the US will take over from there.

Ohio Revised Code 3101.01 states among other things:
“A marriage may only be entered into by one man and one woman.”

How do you change the interpretation of that existing law?

In 1798, the predecessors of the Kentucky legislature declared the Federal Alien and Sedition Acts unconstitutional and prevented the enforcement of these laws. The governor had the duty to protect the county clerk from the Federal marshals by interposing state police. The sheriff of Logan County had the same duty. Both men failed in their respective duties. Until some one with the power to enforce laws takes a stand, Federal tyranny will continue and worsen.

FWIW, this judge is a G.W. Bush appointee. Both parties are to blame for the sad state of this republic.
