Jeez, putting BATF in charge of the investigation is equivalent to putting NAZIS in charge of the post WWII trials at Nuremberg. No, they would never think to try to cover up any misdeeds by their agents or undercover operatives. My suspicions that this was a BATF "provocation operation" gone bad continues to grow. Can they drag things out until after the 2016 elections? My bet is that they will try.

Where does this jurisdiction decision come from? To date we have been led to believe that it's all the City of Waco.

This doesn’t look right... like maybe they’re confusing the Examining Trials with Grand Juries or something.

If an appeals court totally dropped charges on 150 arrestees, it would be all over the news.

What I want to know about is when are the first indictments and arrests occur of trigger happy law enforcement that appears to have committed a massacre. I presume they have delayed release of information so the can still try to bury it, make up new evidence, etc.

This is a stupid article. Yes, only five cases were ruled on and affirmed that probable cause did exist. (Cough.)

Not all 177 requested an examining trial and some who had then withdrew them.

This right here, in and of itself, would be a good reason why Waco has been desperately trying to cover themselves and spraying gag orders all over the place. They knew they didn’t have probable cause in the first place (which given witness statements, what little video has leaked out and the few statements made by Waco PD, is pretty much what many suspected) so absolutely *everything* they did is going to get thrown out in those cases and they opened themselves up for huge lawsuits.

This also can explain the blanket million dollar bail and the hugely inappropriate blanket murder/organized crime/etc., charges - quickly get the arrestee to voluntarily plead out and they can’t sue. They figured out they ‘done goofed’ and tried to make it go away.

Obviously, from his viewpoint, the shooting was coming from the bikers, not the police.

“After being shot, Weathers reportedly ran to take cover behind cars near Don Carlos restaurant. Police arrived quickly and told everyone to get on the ground, he said.”
