Judge blocks Obama EPA rule as federal power grab over state waters

BISMARCK, N.D. — A federal judge in North Dakota on Thursday blocked a new Obama administration rule that would give the federal government jurisdiction over some state waterways.

U.S. District Judge Ralph Erickson of North Dakota issued a temporary injunction against a the rule, which gives the U.S. Environmental Protection Agency and Army Corps of Engineers authority to protect some streams, tributaries and wetlands under the Clean Water Act.

The rule was scheduled to take effect Friday.

“The risk of irreparable harm to the states is both imminent and likely,” Judge Erickson said in blocking the rule from taking effect.

Thirteen states led by North Dakota asked Judge Erickson to suspend guidelines that they say are unnecessary and infringe on state sovereignty.

The federal government says the new rule clarifies ambiguity in the law and actually makes it easier for the states to manage some waterways. It wasn’t immediately clear if the injunction applied to states other than the 13 led by North Dakota.”

I think the problem lies more in the cowards that elected them in an act of ‘pragmatism’. But hey, it was us evil purists that stood on principle that are the real problem...or so we are told to this day by said ‘pragmatists’. God knows the people responsible for liberalizing the gop via the voting booth will never take responsibility for the destruction they caused.

If something like this is Constitutional, then we don't need a Congress. Stop their paychecks.

While the exact amount of land that would be subject to the increase is hotly disputed, the agencies admit to an increase in control over those traditional state-regulated waters of between 2.84 to 4.65 percent.

Congress won’t because they agree with dear leader. For years, they’ve manged to convince the unwashed masses in to believing that there is a 2-party system in this country. Well, there isn’t. I hate to keep repeating myself, but the problem is the Clean Water Act, not the EPA.

The Clean Water Act is an irresponsible, ovebroad and vague grant of power to the Executive Branch to manage the “waters of the United States”. It is one of the original “you have to pass it to find out what’s in it” laws.

Of course, the foolishness of the people in electing people like “Obama” to high office created the present situation. But the power to do these things has existed in law since Nixon signed the Federal Water Pollution Control Act Amendments (PL 92-500).

If you want it stopped, you have to repeal the laws that created the problem to begin with.

As I understand it, what happened here was that Obama had met with Gina McCarthy, Administrator of the EPA. In that meeting McCarthy told Obama that she didn't think there would be much, if any, resistance to the EPA seizing jurisdiction over the state waterways. Now Federal judge Erickson has blocked this power grab and that stops another horrendous Obama edict over states rights.

What I'm thinking here is that since Gina McCarthy has come out of the closet and now openly states that she is a lesbian, then it is most likely the case that McCarthy does not have a normal functioning brain and any advice she suggested to Obama would be suspect. Obama should have known better and not acted on advice from someone who is some kinda' queer! - - rofl.

Another thing to think about is - who is McCarthy's 'partner'? According to that Sun newspaper, McCarthy had met - -Cindy Sheehan in a Washington restaurant and after dinner there, they left together on a Friday evening. Sheehan, in the photo in the Sun, had the queer look with her hair all trimmed up in the back. Obama took advice, bad advice from a lesbian with a brain that does not function properly. So, it is no wonder that Obama made a poor decision that has now ended with his devious plan to seize control over state waterways - a failure. Stupid azz Obama.

I can't post any url to support all this so it can be judged as hearsay. And even though I got this information from a friend who read that Sun article -then related it to me- it is an interesting story about Obama's appointments.
