Waco police detective named foreman of grand jury that may hear Twin Peaks cases

A Waco police detective was selected Wednesday to preside over a new McLennan County grand jury that could be the panel that considers the Twin Peaks shootings.

Yep. Just as a nitpick (your remark is close enough to the process), the weight of evidence at indictment is not beyond a reasonable doubt. Prosecutorial ethics (see Nifong) is that the case should not be tried unless the DA believes the facts will support a conviction (beyond a reasonable doubt), which can be read as either a more strict standard, or slightly looser standard. Generally, weight of evidence is for the petit jury to decide. The grand jury might consider evidence from an unreliable witness (taking it as reliable), and use that to justify the charge. It's ultimately up to the petit jury to decide if the witness is reliable or not; although testimony that is demonstrably false (see Nifong again) is not supposed to support charging.

Oh, one more thing. The presence of generalized bad blood between two gangs doesn't even support an accusation that any particular individual agreed with another, to rumble. It's utter absence of evidence, so the "weight" of it is a nonsense inquiry.

For the cases that result in indictment, that also get to trial, you can bet your bottom dollar that the court will find that “a jury of peers” excludes anybody who is or is friends with a biker.

Showing your ignorance. Grand juries do not hand down “verdicts”. It decides indictments.

Basically, Grand Jury is sort of a Citizens Filter to decide who goes to trial.

Grand Juries look at raw evidence presented by the DA and decide whether or not a person charged will be indicted for the crime and then have a Trial.

Its sort of a Kangeroo Court as it does not have to only rely on sworn testimony and can consider, or reject, any evidence the DA wishes to bring to them. Only the DA presents to a Grand Jury, it does not have to be fair or impartial.

In most PDs, "Detective" is the very first rung of the promotion ladder up from "Recruit" or "beat-walking Patrolman".

If that is the case in Waco, this guy doesn't appear to have had a stellar 34 or even 26-year career...

In the Army, that would equate to being a one-stripe PFC -- at (or beyond) retirement age.

Not, exactly, impressive...

We, in Texas, suffered from 100 years of pure ‘yellerdog” dem rule which gave us many non-conservative laws.

I know Iowa and I know Texas, Texas is a hellofalot more conservative, now.

The thing both the bike gangs and their FR sympathizers failed to understand it that Texans take very seriously the “Don’t Mess With Texas” thing. You want to come here and show your ass, be prepared to get more than the one hour tour of Texas Department of Corrections.

Yep, have to agree with that. It’s gradually being sorted out but there are a lot of ‘good ol’ boy’ networks in place that have been codified in local and county laws.

Treetops, are you under the impression that there are a LOT of FReepers who believe the police/MSM narrative (one and the same) of evil bikers versus knight-like police officers and 177 people got arrested and punished because they deserved it for even being there in the first place?

Thoughtful readers notice contents, and give substance more weight than volume. at least I hope that's the case, and based on feedback I've received over the years, I believe is the case, as well. In other words, don't sweat a large volume of repetitive remarks that don't advance a substantive argument.

Treetops and all, it's a MORALE-breaking goal I believe these dupes/trolls are shooting for when they post three times to every one post opposing them -- and if they succeed, it is worth sweating over because it means they are dividing and conquering even though they are a tiny minority.

WE know that the FReepers (those who've voiced an opinion one way or another, anyway) who are "quite satisfied" to see this abuse of power succeed, are FEWER THAN HALF IN NUMBERS than folks like you and me, who think the police narrative stinks. We EASILY double in numbers the dupes -- however, the dupes post so extremely heavily that it often looks like "many at FR" take their side, when in fact MORE THAN TWICE AS MANY REJECT IT.

Guys like Ethan Clive Osgood, for example -- unless he pays very big bucks to the FReepathon, he is a liability to FR and to American freedom.

Things just keep going more and more sideways in America and the "rule of law" administered by Civil Servants who are "more equal" than the citizens they ostensibly serve, is officially, dangerously broken -- Waco is a quiet throwing down of the gauntlet.
