A massacre took place, and the media barely talks about it. WHY? If the perps were white, right-wing bikers, we would hear about this case, and Congress & Obama would be in an uproar.

I don't truly care if it was the Waco Police Chief, at the Grand Jury level. GJ's will indict a rusty tin can.

If anything like this happens at the trial level, it's pretty much an automatic mistrial.

Cops usually get excluded from jury pools. Unusual to say the least, that one side or the other didn’t DQ him.

I concur.

I wish, however, that sometimes at least the State would pretend to not be doubled over with incessant laughter at the gullibility of the peons they rule.

...19th State District Judge Ralph Strother selected Head to serve as the foreman.

I served on juries four times, as foreman twice. The first time was luck-of-the-draw; the judge said seat number one would be default foreman and that was my number. The second time was by vote of my fellow jurors, because I'd done it before. I'm wondering if the "selection" was luck-of-the-draw or judge's choice.

That's a truly astonishing coincidence. Also just a bit surprising that he got through voir dire.

Not an issue for Grand Jury Duty. Grand Juries typically just rubberstamp whatever the State's Attorney wants.

-- Fox and Hen-house syndrome in Waco. --

That was always going to be the case at grand jury. Either a police representative or the DA is, and has to be, in charge of presenting evidence to the jurors.

Only a handful of bikers were in the vicinity of the initial altercation and shooting, those bikers will be indicted/charged with various crimes of commission.

The more interesting question is whether and how the state will present evidence of conspiracy for those bikers who were running away, taking cover, etc. They were held on an unsupported conspiracy accusation in the first place. By unsupported, I mean the allegation doesn't claim those individuals had (individually) a prior agreement to rumble at Twin Peaks. The only evidence cited is wearing colors, being on the scene, and a general sense of bad blood between the gangs.

Oops, should have “read on” before commenting. I mistook “preside over” as being the person presenting evidence, not as a person receiving evidence.

In other words, free expression, lawful assembly, and something "general" that doesn't even pass the preponderance of the evidence test, let alone the beyond reasonable doubt test.

Are you sure you understand the difference between ‘trial’ jury and Grand Jury?

Although have never had the bad luck to be picked for a Grand jury, I have doubts that “voir dire” is used in picking who goes on Grand Jury.

Good information and facts are your friend. Heresay and BS do not further anyone’s cause.

Obviously sitting in Iowa you have zero knowledge of any particulars of Waco, Texas.

>>> That was always going to be the case at grand jury. Either a police representative or the DA is, and has to be, in charge of presenting evidence to the jurors. <<<

The point is that they’ve made a Waco Police officer the jury foreman. Who’s going to disagree with the foreman’s ‘secret inside information’ as he sits at the top of the table with his badge and gun?

I know a grand jury can indict a rock for jay-walking, but this is just over-the-top blatant in what’s supposed to be a free country that prides itself on the rule of law.

Well they just gave every one that may be “billed” a prima facia cause to have the case thrown out or appealed.
