It is not that simple. The EPA was created to implement the legislation of 1970 Clean Air Act by Congress. Other legislature by Congress was also assigned to the EPA to implement.
To clarify, the 1970 legislation was preceded by the Clean Air Acts of 1963 and the Air Quality Act of 1967 by Congress.

This was a new set of rules. But the EPA has been handing down regulations to the Electric Power Industry for decades, not just this last set of rules. They were given power via legislation by congress. They have abused that power no doubt, but it is a mistake to think the only problem in this area lies in the EPA.
