Supreme Court upholds key tool for fighting housing bias

The Supreme Court handed a major victory to the Obama administration and civil rights groups on Thursday when it upheld a key tool used for more than four decades to fight housing discrimination.

The justices ruled 5-4 that federal housing laws prohibit seemingly neutral practices that harm minorities, even without proof of intentional discrimination. The case involved an appeal from Texas officials accused of violating the Fair Housing Act by awarding federal tax credits in a way that kept low-income housing out of white neighborhoods.

Justice Anthony Kennedy, often a swing vote, joined the court’s four liberal members in upholding the use of so-called “disparate impact” cases.

It’s more nuanced than that if you read the ruling. It states pretty clearly that this is not a blank slate and that
enforcement of this, based on arbitrary basis, could themselves be unconstitutional. Still a bad ruling but not the grand slam some initially thought.

The SCOTUS today does not care about the law or they are being blackmailed or pressured , because it seems every thing bozo the clown is doing is being ignored or passed.

This is not unlike how the SCOTUS began twisting itself into pretzels to find ways to stamp approval on the New Deal after Roosevelt took his head shot with his court packing plan.

Bush senior screwed it up after Reagan had got all but one state Think about that . The country was doing well and it took Bush just 4 years to screw what Reagan had done. The comes along another Bush and screws it up again. Now his brother thinks he could win . Well I will never vote for him or any Bush now.

I wonder if now, the most common screen for renters will be considered discriminatory?

It it possible to say you won't rent to anyone with a credit score under 700, or would that be against the law?

Woe be any suburb that have occupancy and animal ordinances

to avoid “discrimination” neighborhoods will be forced to allow entire clans of immigrants to move into a single family home and keep chickens to facilitate the lovely cultural custom of cockfighting

to avoid “discrimination” better dump those rules about dogs so the pit bull breeders and fighters can run their businesses in your neighborhood

You want to close down the parks and playgrounds at sunset to deter drug dealing? Guess again kemo sabe, cultural groups like to party late at night

You want noise ordinances to keep the peace? Some of my poor neighbors are already dealing with suburban cantinas set up in their midst with loud fiesta music, drinking and partying virtually 24/7 and no enforcement when the cops are called

He did a good job on terrorism for a while. But he really screwed the pooch afterwards. It turns out his compassionate conservatism was just another couple of words that meant unchecked spending and appeasement. He is responsible for Obama, frankly. And for that, I won’t ever forgive him.

Since you and your kind like social experiments I would like for you to participate in one. Build a very nice upscale apartment that is ifenticql in two different locations. One you will rent out only to white people. The other to only minorities. Now visit the apartments 5 years from now and report on their condition and the number of repairs and maintenance that was required by both. Run the numbers and get back to me. Oh is that racist? I didn’t mean it to be. I just wanted you to see the truth and why apartment complexes screen their applicants.

Agreed. His appointment of judges and the last 4 years pissed me off to no end.

Why does out side feel that when they place judges on the bench they have to have a judge who is will vote for the Dems while the Dems place judges with far left views.

Disparate impact is the result of disparate circumstances. I find in renting out apartments that the expenses in maintaining units or reconditioning them after a tenant has left that certain people are much more expensive than others. It is not based on race. It's true that certain groups tend to be from the same races but not always. For those people that show a lack of responsibility, I tend to not rent to them. It is just not worth it financially.

I'm not speaking of about minorities in particular, though many of them fit in this group. Not necessarily just poor people either, though many of them also fall in the group.

People don't behave equally, that is why they are impacted differently.

You can almost definitely kiss your aXX goodbye if you deny someone to rent because of bad credit,since this has “disparate impact” on minorities. They can hire a panther whizz lawyer and make you pay them to go away even if you don’t end up renting to them

You don’t want 12 tenants in a 3 bedroom house? Suck it up buttercup, you are denying someone their cultural custom of living 3 generations together - in a one room shack

Even with the potential for RBG and/or Kennedy or any of the real conservatives on the court hanging in the balance, I will not relent and go for the Mexican Bush. I’m done with settling for the lesser of two evils. Evil will happen either way it seems.

The WH and USSC are way outside of constitutional limitations and the congress is impotent.

I, for the most part, agree with you. The only component of your sentence I disagree with is the assertion that congress is impotent. The current congress is active in its promotion of the radical transformation of our once great nation.
