Biker attorney seeks to replace judges, demands immediate release of clients

An attorney for two men arrested in the May 17 Twin Peaks shootout between rival bikers says his clients are being held illegally and is seeking to replace all McLennan County judges connected to the case.

Austin attorney Adam Reposa alleges in motions filed Tuesday that the charging documents filed against his clients, and the 168 others jailed in the chaotic melee, are legally insufficient.

He also claims that the $1 million bonds are unreasonably oppressive and that the judge who set them and the judges who, so far, have not reduced them have shown bias and should be recused.

Reposa represents Jimmy Pond and Thomas Paul Landers. He said Pond, a mechanic from Hays County, is the sole supporter of his family, which includes a disabled wife and autistic son.

Besides the recusal motion, Reposa filed an application for writ of habeas corpus, alleging a client is being held illegally and without proper cause, and a motion for emergency release so Pond can go home and take care of his family.

After the shootout, in which nine were killed and 18 wounded, Reposa said officials “commandeered” the Waco Convention Center as a makeshift holding area while they tried to sort out the magnitude of the event.

Mac, it's already been released that nearly all of those killed were shot in the head and chest.

Now I could see one or two at most being killed by the bikers that way but once that happened it would be chaos. Logic tells you that at least seven others could not have been killed by rioting outlaw bikers with precision head shots.

Those shots came from rifles so anyone with even basic knowledge can see the Waco police version of events is absolute fabrication.

So far the spokesman for the Waco police has been caught lying and distorting the truth in several instances. First he stated that those arrested were all criminals except the Associated Press has looked up all 170 being held on bond and found 115 to have no prior convictions. Most have never even been arrested.

The police spokesman has also clearly tried to sensationalize the number of weapons recovered claiming 200, 500 and even a 1,000 but had to admit that number what ever he was claiming at the time included pocket knives and swiss army knives.

No one has asked the police spokesman a very important question. How many of these weapons no matter how sensationalized the number were ILLEGAL weapons? Whoopsie daisy - this is Texas, we have concealed carry laws, we can carry rifles in our vehicles with no permits, we can now carry "switchblades" and on and on.

So I will give them a break when the Waco police can even attempt to be a little truthful. Until then everything they say and do is suspect until proven factual.

The desperate authorities responsible for this major league screw up will continue to send up all kinds of stories hoping some will stick. You can bet your boots that the phone lines (they wouldn’t want to put anything down in hard copy and/or digitally using emails) are burning up between DOJ in DC and their operatives in Texas while they try to figure out what to do next. I’m sure that operatives are flying back and forth between DC and Dallas/Waco.

I’m surprised that the DOJ hasn’t locked up Roger Corman (Al Adamson and Dennis Hopper are both deceased) for the youtube videos of the biker films they all directed in the 1960s.

How are the cops going to get all those head shots in the chaos?

Easier to get headshots at pointblank range.

There is a credible first hand account which describes five or six Cossack bikers getting shot by Bandidos at close range. This account supports the police version such as it is and correlates well with the one video that was released to the media. Forensics will determine whether this account is accurate.

The local police might be in over their heads and the DA has a reputation for aggressive asset forfeitures, but the County Sheriff looks like a solid character and I don't think Texas law enforcement is in cahoots with the DOJ.

So I'm not buying into any crackpot theories about a police massacre until more cards are on the table.

Your so-called “witness accounts” have as much credibility as you do...which is none at all. Care to post a link to your “witness accounts”? I believe anything you’ve posted before was hear-say from unknown/anonymous “sources” who claim to have been there. And these “accounts” of yours are all from left-wing sites with a narrative they’re trying to promote.

Please post a link to an actual “credible” first hand source. Anything I’ve seen along those lines reeked of BULL CRAP being put forward by “sources” (who remain unknown/anonymous) CLAIMING to have been there and CLAIMING to have seen those actions unsupported by any independent verification.

Hell, the “credible source” being quoted could be TexasGator for all we know. He seems eager to promote that narrative.

But you’re right, the autopsies and forensics reports along with the results of ballistic tests will enlighten us. I’m betting that the “authorities” will be resisting release of any of those reports to the public and will be fighting any discovery motions as long as they can.
