Maddow Blasts Law Requiring Aurora Shooting Victim's Parents To Pay Gun Manufacturers

Maddow opened her show with heart-rending footage of the Aurora trial. She highlighted the testimony of Brenton Lowak, whose friend Jessica Ghawi -- a 24-year-old aspiring sports reporter -- died in the shooting.

The parents unsuccessfully sued the retailers who made the firearm that killed their daughter. Colorado state law requires that plaintiffs who sue the manufacturers of gun products pay the companies' legal fees if they lose.

“That’s not a typo,” Maddow said, adding, “The mother and father of the victim who died in the Aurora mass shooting have just been ordered to pay a quarter-million dollars to the gun makers who sold the bullets that were used in the Aurora mass shooting -- the parents of the girl who was killed.”

That’s a good law.

Well, the outcome was excellent in this case. Do these laws do more good than harm? I don't know. They cut down on lawsuits. They also discourage access to the courts if you don't have deep pockets.

Their attorney was remiss if he did not explain that possibility to them.

They should sue him for losing, and maybe could break even, or risk losing another quarter mil. 😂

A judge doing something right!

After they reimburse the gun company, they should sue their lawyer, who should have warned them!

First thing I’d want to know is if any of the usual suspects in the agitation department (Brady, Bloomberg, etc) had a hand in encouraging, supporting, or in any other way pushing the parents who filed the suit.

If so, then if I was the ammo manufacturer, I’d let it be known that I’d forgive most if not all of the settlement if given an appropriate apology, with a generous helping of blame placed on the shoulders of those in the anti-gun lobby who might have encouraged them.

But if he doesn’t, I don’t care these people are communist, statist, bullies who are attacking YOUR constitutional rights and YOUR right to defend your family. Or it might be a horrible idea that encourages more people to carry on with their liberal ideas of ‘justice’ through unwarranted enrichment.

It sucks the kid died. It is not the fault of the mfgr. The Ammo mfgr should not have to be victimized the grieving parents or liberal lawyers and should be paid back all they spend defending this stupidity and far more.

These nutcases endangered the livelihoods of a lot of employees and had they succeeded, endangered millions of American lives by making it harder to maintain 2A rights.

If Maddow is so concerned, will she pay the quarter million incurred for a lawsuit that even a rookie lawyer would know couldn’t be won in court?

Can only assume the parents were on a cowardly insurance company paying them to go away.

If he didn’t tell them of their potential liability, he should be disbarred. His disbarment could be helpful in any lawsuit they bring against him.

But if they were informed and aware of their liability, then they are certainly responsible for the risk they took.

Doesn't the judge have some discretion as to whether the case was indeed frivolous, the level of frivolity not being determined by the extent of the loss?

Also, loser-pays should not apply to cases against the government, such as Burwell v. Hobby Lobby.

If he or she did not, well, bring the atty in on the suit in a malpractice claim.
