Ms. Mosby stated in her ranting recitation of the charges against the police: "... a knife that is legal in the State of Maryland."

She did not say anything about the City of Baltimore.

The police she defamed work for and have jurisdiction in the City of Baltimore.

She also works for the City of Baltimore.

She should be arrested.

"The knife was an after-the-fact excuse."

I think it's called "evidence".

What’s fascinating is the prosecutor needs the knife to be legal in order to charge the 3 white officers for illegal arrest and assault. Those 3 officers involvement in the case ended when his legs were shackled and Freddie was placed in the van. Take away those 3 officers and she would be left charging only 3 black officers. Riots may still be going on.

“...or other device for opening/closing the blade.”

This would likely mean that if the knife had a thumb stud, thumb plate or a “bird’s eye” to assist in opening, it would be illegal.

If they can’t figure it out, how is an avaerage citizen supposed to know?

Exactly. This way you end up in the system so cops and lawyers will have plenty of work.

“This would likely mean that if the knife had a thumb stud, thumb plate or a “bird’s eye” to assist in opening, it would be illegal.”

According to the article the law defines a switchblade as a knife with “a blade that opens automatically by hand pressure applied to a button, spring, or other device in the handle of the knife.”

In all of the assisted opening knives I have seen the thumb stud, wave or bird’s eye is NOT in the handle.

If so then why do laws restrict knives in multiple ways? Not disputing, just reality that 2nd amendment focus is always guns.

Knives do not fall under the 2nd amendment, correct?

If a bayonet (knife attached to the barrel of a rifle) is not an arm, what is it?

If a bayonet is an arm, which I assert it is, does it cease to be an arm when it is wielded in the hand instead of being attached to the barrel of a rifle?

The second amendment is silent about what constitutes and arm just as the first amendment is silent about the medium used to communicate speech.

Indeed, you are correct- easy to regulate by .gov, however, arms is arms, notice in the GCA an PL, knives are included ( the ban on knives in fed gov buildings etc is in the same US code para 922 just like suppressors and handguns and body armor, all fall under “arms”). The reality is that firearms re th regulated tool of the era as they are considered most effective- early warriors used a gun, the dropped it and drew sabers, pikes, swords, knives etc, we in the profession of arms today carry much of the same tools- bayonets, fighting knives, handguns etc to do the same, we just rely on rifles and machine guns for the heavy lifting due to effectiveness.

Knives, swords, axes, spears, clubs, are all arms under the definition of weaponry that includes firearms. The 2nd Amendment does not specify just Firearms.

OK say for the sake of argument that Freddie Gray was not killed but instead got hauled in to jail intact. Does anyone really think that the police would have held him on th weapons charge much less prosecuted him?

“. . . these officers by their actions or inactions, killed Freddie Gray.”

Verdict first. Then the trial.
