Ted Cruz, the Times, and Guns

The New York Times is taking note of Senator Cruz’s suggestion that the Second Amendment was intended to “serve as the ultimate check against governmental tyranny — for the protection of liberty.” The Gray Lady calls it among the “ridiculous arguments against gun control.” It suggests the silliest such the idea is that the framers wanted to “preserve the possibility, or even encourage, the idea of armed rebellion against the government.” What arrests us about this note is the absence of any reference to Elbridge Gerry.

Gerry was the representative from Massachusetts who, during the debate over the Second Amendment in the First United States Congress, marked the point to which Senator Cruz refers. The House was considering an early phrasing of what became the Second Amendment. Namely: “A well regulated militia, composed of the body of the people, being the best security of a free state, the right of the people to keep and bear arms shall not be infringed; but no person religiously scrupulous shall be compelled to bear arms.” Here is what Gerry said:

“This declaration of rights, I take it, is intended to secure the people against the mal-administration of the Government; if we could suppose that, in all cases, the rights of the people would be attended to, the occasion for guards of this kind would be removed.” What bothered him, he went on to note, was the religious exemption, which, he feared, “would give an opportunity to the people in power to destroy the constitution itself. They can declare who are those religiously scrupulous, and prevent them from bearing arms.”(continued)

I take it to mean that our forefathers recognized that we were born into this world free and without human masters and the bill of rights recognizes that a free man has certain inalienable rights, that is, rights that are not granted by men and which can not be taken away by men as they originate from a higher authority than men, our creator.

The right to keep and bear arms, as such, is not so much about God wanting us to have firearms but, rather, God wanting us to have freedom. The right recognizes that unless both parties of the social contract have the power of firearms, there is no freedom.

Though we have abrogated certain rights by nature of the social contract, there are yet certain rights which our forefathers deemed sacrosanct and they were included in the Bill of Rights and the purpose of all of them was to maintain balance between the government and the governed.

Of course the second amendment is about resisting tyranny. If a person truly does not recognize that simple reality, that person is unfit to be an American citizen.

Some folks are so used to a corrupt and power hungry set of “rulers” that they cannot conceive that some would actually have government serve the people instead of the other way around - Reagan warned us how quickly Freedom can evaporate and our idyllic verbal responses as the Left has made it so should shame us.

Seems a bit laughable to me to believe that a group of people who had just finished fighting a war of independence against a tyrannical British monarchy would not want their descendants to have that same capability should the need ever arise again. Further, placing the second amendment in the context of the entire Bill of Rights, which as a whole is a check on the power of government against its people, would seem to take the liberal anti-gun premise from laughable to the realm of the absurd. For anyone with an IQ above room temperature, its rather obvious that Ted Cruz is correct.

Then again, logic and common sense have never been strong points for the vast majority of liberals.

It’s important to note that at the time our constitution was written, there were no police departments as such; only constables, watchmen, and volunteers.

On learning this, gun control types would jump in and say, “now that we have police, we no longer need guns”. But this is a false conclusion. Instead, this was not a subject for debate at the time; the assumption being that “the people *are* the police.”

Taking this point of view, uniformed, organized police are just a *convenience* to the public, and the authority of the uniformed police directly descends from the police authority. And that is how the founding fathers viewed the second amendment.

This is seen today in the myriad strict rules that police must obey as our proxies in law enforcement. Importantly, rules that ordinary citizens are not constrained by.

Think of a shooting. No matter the circumstances, police officers are grilled, examined, and must testify to the events before boards, inquests and trials, and are put on temporary desk duty. But if an ordinary citizen shoots someone, if the police determine the shooting was legitimate, that can be the end of it. The citizenry truly have “a license to kill”, if doing so stops a serious felony from taking place.

I had a debate with a Christian once about that the bible tells us to obey our government and authorities since God is the one who ordained all governments.

I told this christian, to obey government to the point that if his wife was a nurse and a Christian and was told to perform a abortion ?

Or obey to the point where the church is forced to ordain homosexuals in the ministry and pulpit ?

He hemmed and yawed , stuttered and all he said to me is that is not what it really means.

Then I told him, “ GOD SAVE KIND GEORGE III , “

Since ? with that frame of thinking : George Washington, John Adams, Samuel Adams, Thomas Jefferson, Benjamin Franklin were all rebels,

and I ask him ?

Do you think that the United States of America is a rebellious illegitimate country ?

I should have asked him,

Why then ?
