Right to Bear Arms? Gun grabbing sweeping the nation

Cherished family heirlooms were among the 21 firearms Michael Roberts surrendered to the Torrance Police Department in 2010, after his doctor filed a restraining order against him.

The court order was the result of a dispute Roberts had with a member of the doctor’s staff and, after Roberts pleaded no contest, the matter was resolved. Yet, even though he filed the proper Law Enforcement Gun Release paperwork on four separate occasions, obtained clearance from the California Department of Justice and had two court orders commanding the return of his guns, police refused to hand them over.

With the backing of the National Rifle Association and California Rifle and Pistol Association, Roberts filed a federal lawsuit in May 2014, over the $15,500 worth of firearms. In the end he got the money, but not the guns. The police had had them destroyed.

That’s rich.

I had an employee years ago at a vineyard I managed who drew time for threatening his father in law at a picnic with a firearm. THis Hallmark moment only drew him 90 days in the lockup as everyone was afraid to testify against him. Such as things are, he only does 45 and is out and is coming to the vineyard to pickup his firearms; a 9mm, an AK and a shotgun. I called the Sheriff’s office and informed them. They said they were his and had to return them. I told them he was a felon and we had a restraining order against him. Still, the department insisted I return them even though one is out right banned. Before I complied, I disassembled the weapons and filed down the firing pins making them all inoperable. I figured if he came back after me for firing him I could look like a bad ass for once in my life by taking the weapon away from him.

Police need to be held personally liable for destroying people's lawful property.

This calls for CRIMINAL PROSECUTION ... felonious destruction of property.

Perhaps if they had to pay double the market value of property they destroy there would be less of that.

Not enough. If you or I took $15,000 worth of someone else's property without his consent and destroyed it, we'd be looking at criminal prosecution and prison time.

These "officers" belong in prison.

I would believe that those firearms are now in the private collections of the officers of that department. Now they can not surrender them without getting arrested themselves. Yup, they split them up.

Unlike you I shall refrain from name calling.

The individual in question had kept a 13 year old girl on the property prior to my arrival. He and his friends had their way with her (their defense was she wanted it). He threatened to kill his father in law. He threatened to kill his wife. He threatened to kill the foreman and his wife. He threatened to kill my girlfriend. He threatened to kill me. Yes. I was an ass and did not arm a convicted felon, rapist, drug dealer, and one who sought to do more harm. I do not care who tells me to give him a weapon. I would have to be an utter moron to arm this POS. I could have disarmed him in the manner I did or I could have blown his scummy person away and lost him forever. I know I made the right choice.

I take it you have no problem with the Fugitive Slave Act requiring that "property" escaped from a plantation owner be returned to the plantation owner.

Under principles laid-out in the Declaration of Independence, government derives its power from the consent of the governed.
