Mark Levin exposes the treachery in the US Senate today, who he says just capitulated completely to Obama by gutting their own constitutional duty to approve treaties, giving it solely to Obama.

So in short, Obama can make a treaty with the Islamo-Nazis in Iran without submitting it to the Senate and the Senate can only stop it if they can get enough nays to vote against it.

I’m confused. “approve it”... and “vote against it” seem functionally the same to me.

The House is not involved in this because this is a senate only function in the constitution, as far as I know.

So, if this "deal" is not legislation but just an informal agreement among friends then the Senate could change its mind at any time and rescind it.

It’s kind of like the War Power they’ve handed over for decades. For the longest time our elected “leaders” have skirted the law and Constitution simply by saying “oh gee. Let’s just call it something else. It’s not a Treaty it’s an agreement!”

Approving a treaty requires 2/3 yes votes. Vote against it requires 60 senators to break a filibuster so 40 wanting it would be able to prevent disapproval and allow it to go into effect. There's a huge difference between needing 67 and 40 to "approve it".

If it's a bill for the President to sign, the House has to pass it, too.

Regardless, they cannot legislate away a power. Only an amendment can do that.

This stinks of McConnell. It's the same deal he made for the debt increase that undermined Boehner in the House - allow it with an unreachable override clause.

Since the Senate is the body that represents the states, the states will have to sue on the grounds that it violates the Article IV guarantee of a republican form of government. The Senate must uphold it's treaty power. It cannot twist it into a treaty super-majority veto override power.

It is a huge difference. The constitution REQUIRES the Senate to approve any treaty. This means that BOTH the Legislative and Executive branch MUST agree to the proposed Treaty.

The Senate is now saying that the default is that ONLY the Executive branch needs to make a proposal and it is now by default considered Approved without any action by the Legislative branch. The only input from the Legislative branch is if they can MUSTER enough votes to over-ride a veto!

The Executive branch can now enter ANY treaty that they want and it will be considered approved by the Legislative. Unless the Senate votes it down with a VETO-PROOF majority.

Now, think of this applied to the UN “guns treaty.”

With this action, the Senate has handed the President DICTATORIAL power!

The law was that it took 67 votes in the Senate to approve any treaty.

NOW, the doofus assed Republicans have decided that the Senate gets 30 days to look at the treaty and either approve it or not approve it, BUT the Obongo can veto their ruling and it will take 67 votes to override Obongos veto.

Something like that. ugh No wonder Obongo approves.
