Some great news for the taxpayers of California. A man convicted of murder and currently serving time in state prison has managed to convince a judge that the state will pay costs of at least $100k for gender reassignment surgery since he’s suffering from gender dysphoria.
A federal judge on Thursday ordered Californias corrections department to provide a transgender inmate with sex change surgery, the first time such an operation has been ordered in the state.
U.S. District Court Judge Jon Tigar in San Francisco ruled that denying sex reassignment surgery to 51-year-old Michelle-Lael Norsworthy violates his/her constitutional rights. Her/His birth name is Jeffrey Bryan Norsworthy…
Norsworthy, who was convicted of murder, has lived as a woman since 1990s and has what Tigar termed severe gender dysphoria a condition that occurs when peoples gender at birth is contrary to the way they identify themselves.
The weight of the evidence demonstrates that for Norsworthy, the only adequate medical treatment for her gender dysphoria is SRS, Tigar wrote, referring to sex reassignment surgery.
I only noticed this story because it was picked up by Dr. James Joyner at Outside the Beltway. He has some interesting thoughts on the topic.
Not much has changed in either my thinking or legal precedent since my August 2013 posting on Chelsea Manning and the Law. In Mannings case, the US taxpayer is paying for hormone treatment. On balance, that strikes me as reasonable. Gender dysphoria is a serious medical condition and, as general rule, prisoners are entitled to proper medical care.
This case takes it quite a bit further. Sexual reassignment surgery is much more drastic a measure than hormone therapy and much more expensive. The AP story estimates that it could run as high as $100,000 depending on the circumstances.

Secondly, the victim’s family (if there is one) should sue him in civil court for his tangible financial gain (the cost of the operation) as a profit from crime. Lastly, drop a dime on his ass to the IRS for tangible financial gain that was not taxed.
I was initially turned down for an operation to alleviate chronic pain because it was for “lifestyle.” I presume there are no longer any lifestyle restrictions?

Now that plastic surgery is a “right” who in the gub’mint can deny a flat woman implants or someone with a rotten schnoze something that would improve his or her self-image?
Miss Thing has been incarcerated since 1987 for 2nd Degree Murder. S/he has twice delayed scheduled parole hearings in recent months, presumably to further bilk taxpayers for the expensive surgery. A dangerous precedent, the decision should be appealed and overturned.
That’s an excellent point. I hope that’s not what ends up happening though.
But, it’s ironic that not all cosmetic surgery is covered for people who truly need it due to illness or injury. Yet what this convict wants to do is considered necessary?
When it’s a murderer who is in prison, there is no need to pay for the surgery when the pain pill would do (as Barry O would say).
So how is this different than thinking you are a penguin or Napoleon? Can someone get a free operation for that?

I have researched my copy of the US Constitution, Bill of Rights, Declaration of Independence, Federalist Papers, etc, and I have yet to find that part where it says that perverted pieces of human excrement that wish to screw over the system should have their junk cut off and mascara issued to them, all at the expense of the United States taxpayer.
Can anyone help in this?
