OKLAHOMA CITY — Oklahoma would stop issuing marriage licenses under legislation passed Tuesday afternoon by the Oklahoma House of Representatives.
House Bill 1125, by Rep. Todd Russ, R-Cordell, would instead require those officiating marriage ceremonies to file after-the-fact “certificates of marriage” with court clerks’ offices. Alternatively, couples could file affidavits of common law marriage.
Russ said his bill is intended to “protect” county court clerks who do not want to issue marriage licenses to same-sex couples.
“This takes them out of the trap,” he said.

The state has an interest in marriage as providing special benefits to those reproductive couples committing to raising any offspring together so the kids do not become wards of the state.
If “marriage” is just any pairing, even when reproduction is utterly impossible based on genders alone, then the objective necessity evaporates.
Oklahoma is one of the states that already passed a religious freedom law!
Yeah, governments will still be in the business of recognizing it because of other laws surrounding marriage and things like benefits to surviving spouses.
In fact, with this I would warn people to be SURE to have something legally recorded or else many laws that guarantee rights and benefits will not apply to you!
Yep! There are a lot of laws out there, which are actually to the benefit of married couples, so that if they weren’t married, legally so (but only so in some informal and personally recognizable way) ... they would lose out!

You are obviously correct. But if you boil marriage down to its two secular fundamentals - issue and property, how will we in the future deal with the issue part? Family court and Estate matters aren’t going to go away.
Exactly. There's no reason a sexual or marital relationship should be acknowledged or implied by the state when two people choose to take legal responsibility for each other.
Best example I heard of this was years ago when two female war widows wanted to be responsible for each other and their children if something should happen to the other. A civil union would be a way of insuring that the children wouldn't be moved around if something happened to one of them.
If gays want to be "married", let them find a willing church. Years ago, when this started, I have a relative who was one of the first "married" to his partner in VT. At that time, the town issued a Civil Union that was separate from the Church wedding (two guys in tuxes). The restaurant that provided the dinner....it was a real nice dinner but not particularly identifiable as a wedding party.
Why couldn't the gay crowd be satisfied with that?

relax, married couples of any substance pay more tax than 2 singletons (marriage penalty). One of those husbands just became 3/5 of an earner in terms of tax sheltered income

An affidavit is a sworn Oath of Affirmation..basically you and your spouse write down that you consider yourselves man and wife, swear it before someone at the clerk's office, sign it and file a copy with the State.
What most people DON'T GET is that a 'license', of ANY kind, is legal permission. You're basically asking for the State's approval to do whatever action the license is FOR.
(That's where the progs get us on the issue - the State cannot discriminate, or 'disapprove', anyone who's a member of a protected class.
A common law marriage just basically means that your marriage is a matter of record in the State, and I see no reason the current protections and benefits wouldn't apply.
If you don’t have state certification that you’re married then how can you get divorced?
Because in all the other states the legislation protects you from the state or local government placing undue restrictions on your ability to practice your faith as you see fit. The Indiana law was the first to also prevent private individuals or organizations from interfering with your ability to practice your religion.

As I read it, the parties to the marriage present a certificate of marriage after the fact. I’d imagine divorce could still take place as a private matter resolved between the two.
I don't see why it should. The state is saying they won't issue marriage licenses to anyone. They aren't saying they'll issue licenses to some and not to others.
