The First Amendment Should Never Protect Hatred

One of the most admirable things about Europe is that most (if not all) of the right-wing rhetoric that you hear in the US is explicitly against the law there. For example, attempting to link Islam with terrorism, saying that gay marriage isn’t really marriage, or saying that trans women aren’t really women would get you charged with discrimination and/or incitement to hatred. Numerous European public figures have been charged with hate crimes for implying that large-scale immigration is connected to higher crime. In fact, a politician in Sweden was prosecuted for hate crimes for posting statistics about immigrant crime on Facebook. Assaults on the human dignity of Muslims are simply not tolerated in Europe, and Europe cracks down hard on any attempts to incite hatred against Muslims. In a notable example, a woman in Austria was convicted of a hate crime for suggesting that the Islamic Prophet Muhammed was a pedophile. Recently, a man in Sweden was charged with incitement to ethnic hatred for wearing a T-shirt saying “Islam is the devil.” Nobody in Europe believes that these laws interfere with their sacred, guaranteed right to freedom of speech. Rather, these laws protect freedom of speech by ensuring that it is used responsibly and for the purposes of good.

Nobody in Europe believes that these laws interfere with their sacred, guaranteed right to freedom of speech. Rather, these laws protect freedom of speech by ensuring that it is used responsibly and for the purposes of good.

Is this satire of some sort? Please tell me it is.

What someone finds offensive is very subjective. Unless there is direct incitement to violence, the maxim “sticks and stones may break my bones but words can never harm me” should apply.

Tanya would not be allowed to write that article if hate speech was banned.

I'd guess that she really wants the first amendment to not protect any speech that she disagrees with.

I once heard a lecture by Justice Kennedy on the 1st Amendment. He is, by the way, an exceptionally gifted public speaker. The first thing he said was that all, without exception, all of the 1st Amendment cases the court has ever ruled on involve horrible, despicable, really undefendable speech. He went on to emphasize how remarkably repulsive it always was. Yet, the strength of the 1stAmendment was that even that was protected.

What I’d like to know is how do you make a living at being an agitator and activist in this day and age?

Does it involve burying some valued items in the middle of a country crossroads and making a deal-sealed-with-soul with the next arrival?

While America has always been far behind the rest of the world when it comes to basic human rights – we still have yet to ban firearms, we still have yet to provide free higher education, and we still have yet to implement free universal healthcare,

Last time I checked North Korea has all of these wonderful free things....and very responsible "free speech" that is for the "common good".

I'll be more than happy to pay for a one way first class ticket for her to move to NK.

So I was curious about this author, Tanya Cohen. I did a little research on her and the interesting part is she is Jewish.

A Jew advocating for a totalitarian state and limits to speech. I bet she’s against mentioning Nazis and the holocaust also.

She's not against hate per se, but rather right-wing rhetoric. She has no problem with left-wing rhetoric, no matter how vile and disgusting...

“Most champions of hate speech are straight, white, Christian males who have never had to experience the devastating consequences of hate speech. These highly privileged members of society will never understand the harm that hate speech causes to vulnerable minorities”

I find that statement to be offensive and based on hatred on the grounds Ms. Cohen is condemning a whole class of people. Therefore based on your own standard you should face legal consequences.

Since the first amendment was intended for political speech but the libs have perverted it to mean all speech I think we have a problem. Now that the first amendment covers all speech then ALL SPEECH should be protected. This political correct BS is just that BS. If you feel that you have to call someone a name that should be on you and not be called a crime by some whiny little crud that just doesn’t want to hear it. Free speech should be free speech not what anyone says it is.

Old enough to remember when America was a free country.

Seriously? I’m not buying it. Surely the people are at least a little bit free over there.

Kennedy is a about as liberterian a justice as they come. It is a double edged sword. He is strong on free speech,w as the deciding vote on the 2nd amendment is an individual right, and tore traitor Roberts a new one with his dissent in the ObamaCare case. On the social issues some care about not so much. At least he is consistent about wanting to restrict gov’t power.
