Even with that, it will not become legal matter. The worse they could do is to kick the person who took the video out of their defunct fraternity.

Or publicize the identity of the recorder, labeling him or her "The snitch among you".

I agree, plus they are young and prone to bad judgement. In the meantime, black on black violence continues with hardly any notice. The race industry can’t make any money from that.

The offense, in my opinion, was not worth ruining their lives and futures over. Their singing did not cause any injury to anyone (or at least, no injury comparable to what happened to the frat boys).

A better solution would have been to send the recording to the frat president, and have the two quietly kicked out of the frat.

“Or publicize the identity of the recorder, labeling him or her “The snitch among you”.”

If and when that is done, you have the First Amendment Right to protest in front of the recorder’s house and chant condemnation upon him for violating the sanctity of the frat party bus.

Or, as an employer, quietly decide I don't want this person working for me, in case he (or more likely, she) witnesses speech between two employees inside my company that he's offended by.

That could be the case, and I would support the employer in his decision.

However, I bet that dude that records someone saying that blacks should be hanging from trees has a better chance of getting a job than dude who says blacks should be hanging from trees.
