Lawmakers rally around expanded background checks for gun sales

The gun battle is raging on Capitol Hill.

Lawmakers will introduce new gun safety legislation Tuesday expanding background checks to prevent criminals and people who are mentally ill from buying guns.

Most gun shops are already required to conduct background checks, but the rules don’t apply to firearm sales made online and at gun shows. The Public Safety and Second Amendment Rights Protection Act would close this loophole and expand background checks to all gun sales.

“This bill is anti-criminal, and will help keep spouses, kids and communities safe by preventing dangerous people from getting guns,” said Rep. Mike Thompson (D-Calif.), who will introduce the legislation.

But the gun safety legislation comes in stark contrast to recent Republican bills that would expand concealed carry laws across the country and allow hunters to use armor-piercing ammunition.

Gun rights groups are gearing up for a major concealed carry push.

I'd sure like to see any one of these pols try and buy a gun online without going through an FFL dealer.

Will these politicians exempt themselves from both restrictions?

A restriction on criminals and the insane purchasing weapons would hit the them all pretty hard - especially the democrats.

I like the coexist bumper sticker. My brother in law gave me one but I am too afraid to put it on my car. We live near Liberal Boulder CO — those loving peace activists can be pretty violent and destructive.

Hunters can already use armor piercing ammunition. I doubt if the deer cares if the round is armor piercing and neither would I. The expansion of carry laws in my state (Kansas)is simply saying "if you can openly carry a gun in our state without a permit or training why should a CCW be different.

Personally, if some idiot is going to abuse CCW by blasting away indiscriminately , I am hoping he hasn't had much training.

How does a background check prevent people who are "mentally ill" from buying a gun if Federal regulations under HIPAA prohibit the disclosure of medical information about patients?

LIES! The same rules apply EVERYWHERE! This is nothing but an effort to force private citizens to go through a FFL dealer to conduct a private transaction so they can create a national database of guns and owners.

FR: Never Accept the Premise of Your Opponent’s Argument

Note that regardless what FDR’s thug justices wanted everybody to believe about Congress’s Commerce Clause powers when it decided Wickard v. Filburn in Congress’s favor in 1942, FDR’s justices wrongly ignored that a previous generation of state sovereignty-respecting justices had clarified the following. The earlier justices had indicated that the states have never delegated to Congress, expressly via the Constitution, the specific power to regulate intrastate commerce. And over-the-counter gun sales are reasonably a part of intrastate commerce.

”State inspection laws, health laws, and laws for regulating the internal commerce of a State, and those which respect turnpike roads, ferries, &c. are not within the power granted to Congress [emphases added].” —Gibbons v. Ogden, 1824.

As a side note to this discussion, please consider the following. Given that there are no clear delegations of power in the Constitution by the states for the feds to regulate firearms used for personal protection, it is disturbing that gun laws evidently started appearing in the federal books during the time of Constitution-ignoring FDR.

BULLCRAP. Bald faced lie. Online sales require 100% background checks. They are performed at the location of the FFL the buyer has it shipped to. Furthermore, if any FFL sells at a gunshow, it is exactly like he did it in his store.
The only gunshow without a check is if two private parties swap or sell. The only way to stop that is to require ALL transfers to go through an FFL. The only way to enforce that is full gun registration so you can prove who owns what.
