CARSON CITY — A Nevada assemblyman was arrested early Friday on suspicion of drunken driving after a Carson City deputy found him asleep in a car outside a bar with a gun in his pocket, authorities said.

Democrat or not, there is a problem with this story. The guy is in a PARKED car, ASLEEP. Where is the DUI in that?!

Instead, Democrat or not, the guy should be credited with not driving. An otherwise smart move ruined by idiot police.

Yep! I figured that when that wasn’t the first thing they mentioned in the first line. The Lamestream Media tends to identify Republicans in the first line or even the headline. When they don’t mention it, you already know ...

Agreed; this happened to one of my soldiers at Ft. Riley many years ago. His girlfriend was the designated driver when he went to Manhattan one night. They got in an argument and she left with some friends. He was drunk and didn't want to drive so he went to sleep in the backseat of his car and got busted for DUI on a technicality. Apparently he had started the car to warm up the interior and the Kansas law said something to the effect of "operated or attempted to operate" the vehicle while intoxicated. It was over 20 years ago so I don't remember the exact details....

Agreed. This is a drunk in public case, not a DUI. The vehicle code for Nevada should define what operating a motor vehicle is. If he was not operating it, then the charges should be dropped.

Never mind that this is a Dem. This is about whether the laws mean what they say or what a police officer says.

You can still be charged with DWI/DUI IF the keys are in the ignition. Even if the person is asleep... the keys have to be out of the ignition. Personally, I can’t stand drunk drivers but playing devil’s advocate.. let’s say he knew he had too much and wanted to sleep it off till morning?

BTW.. the car doesn’t have to be running. The keys simply have to be in the ignition.

He probably had the Key in the ignition because he was listening to one of Obama’s Books on Tape and fell asleep.

In Florida they do not have to be in the ignition. Just the operator has access to the keys. You can be asleep in the back seat, with the keys in the trunk. If you have access, by popping the trunk you’re toast.
Only answer to the cop when the cop finds you asleep, is that your friend took your keys.

That varies from State to State. Texas is also a state that can give you a DUI if you are drunk, and asleep, in a parked car. But, BOTTOM LINE: It’s still always up to the Officer’s discretion.

Back when they had pay phones, there was a guy outside his car, using a pay phone in a Houston suburb. His car was parked in front of the pay phone, and he was drunk. Two policemen sat and waited until he got off the phone. He admitted the car was his. Since he could not prove that anyone else had driven him to that location, he was charged with a DWI; outside of the vehicle.

Did not know that...in Maryland.. it is all about the ignition. You can also get locked up for DWI if you have been drinking and pushing a baby carriage.

This is what happens when the media write the laws. All the DWI laws since 1970 have been written based in media hysteria and no common sense.

My brother who retired from the state patrol said the “alcohol related” statistics about accidents are completely inflated and unreliable. Finding an empty in a car - did not matter even if *that* car was not at fault - made the accident “alcohol related” in the reports.

He is a teetotaller.
