Rape by fraud? N.J. lawmaker introduces bill to make it a crime

Imagine this: A man woos a woman to bed with tales of his riches, fast cars and a vacation home in Monaco. But he actually lives in his mother’s basement.

Or this: A seemingly wealthy widow convinces a younger man to sleep with her on the notion that they may marry and he’ll inherit her money. In reality, she’s broke.

In both cases, someone lied about his or her status in order to have sex with someone else.

Under a bill recently proposed by a south Jersey lawmaker, such actions would not only be considered dishonest. They could prompt charges of rape.

What about saying "I love you" when what you really mean is "I'd love to." Is that now a crime in New Jersey?

If that includes lying about being single, or being ten years younger or fifteen pounds lighter than you really are, or saying "yes, they're real," I think the whole state could be indicted.

Maybe there's some good to be salvaged from this. Is it now a crime in New Jersey for a woman to lie about being on The Pill?

Such lies are legitimately the basis for annulments. But any law that tries to distinguish between “honest” and “dishonest” fornication or adultery should be opposed.

If it was in writing, a case could be made for “fraud in the inducement” under contract law. That would void the contract, and, since the person who “sold” the sexual service can’t get it back, he or she could ask to be indemnified in cash.

May as well station police outside of the bars. 90% of the folks leaving together after 11PM would fit this description.

This appears to be largely a revival of the ancient common law crime of seduction.

How about a law to make it a crime for politicians to lie to the voters.
They promise big, deliver nothing and screw millions, even those who didn't vote for them.
Isn't that closer to rape than a verbal seduction is?
I'm not saying it is rape, that word, like racism, is already overused.

It’s completely legal to lie except when offering services IN WRITING.

I'm not an attorney, but I don't think that's true. The defining element of the fraud is deception. That can be verbal or written.

It is, of course, much more difficult to prove a fraud without written evidence.

I do know here in Florida there has been some high-visibility prosecutions of people for defrauding old folks. The contracts they signed were entirely legal, but their signature was obtained by false verbal inducements.

Interesting. What if this happens and the normal person finds out that their willing partner for the evening has the wrong plumbing? Will they arrest the deceived party for anti-LGBT bias?
