Yes Executive Orders are "Constitutional'. It was done by many other Presidents. For the record, this is how Democrats are defending this.

However....., Executive Orders ONLY APPLIES to the Executive Branch.

They DO NOT APPLY to the Legislative or Judicial Branch.

THEREFORE......,

Yes one branch of government, DOES NOT HAVE THE CONSTITUTIONAL AUTHORITY to SEIZE the power of the Legislative/Judicial branch.

Executive orders ONLY HAVE AS MUCH POWER that is granted to them by the U.S. Constitution. Furthermore, again.... it only applies to the Executive Branch and not the other two branches of government.

Thus, by directing other fed government agencies that fall under the Executive branch to violate and break U.S. Law........., is HIGHLY illegal.

One man is NOT above the Supreme Law of the land The U.S. Constitution. He is NOT our Creator..........

If the Legislative branch does nothing, then they are simply ceremonial at this point.

Obama has been breaking the law every time he alters the ACA without the constitutional authority to do so. Congress and the Supreme Court share in Obama’s culpability, because they have permitted it to go on. Now he is doing the same thing with immigration law. If he is allowed to get away with it, he will do it with other issues, like gun control.

Has anyone seen the executive Order?

There does not appear to be one. There are two orders that establish study groups to study immigration and report back to the president on how the immigration system can be improved but no EO that directs the actions he outlined, (vaquely), in his speech.

There is also Secretary Jeh Johnson’s order of prosecutorial discretion that catagorizes the types of illegal immigrants that are priority, but that is within the law for him to do that.

Then, read the transcropt of O’s speech and you will see that he never once says “Executive Order”.

I think that 1) he knows that if he signs an EO with specificity of the actions he is ordering than he gives standing for a law suit. 2) he punked the GOPe’s, (and the latino community), because he has not ordered any action, officially, to be performed by his executive agencies.

How does this help him? It gets the news cycle on the conservative media screaming bloody murder and it makes the latino community think he has just fulfilled his promise for amnesty. He can then say “see how radical the Republicans are that they would jump to the conclusion that I had violated the law and constitution when I actually only ordered that the subject be studied. See how much they hate immigrants and want to harm them. They have no compassion”.

But actually Obama has done exactly that for 6 years and he has had the acquiescence and assistance of democrats in congress and the senate in doing so.

In fact, he could not have taken the unconstitutional acts that he has without them and their willing support.

The democrat of today has become the analog of the communist party in the old Soviet Union.

Party loyalty and allegiance is supreme and demanded by party leaders. To democrats, obligation to the party comes before and above any other, including the oath they swear to uphold the US Constitution.

Theoretical thought aside, the plain simple fact is, the President has taken the power and applied it as he chose. It doesn’t matter what the law or Constitution is believed to say, he is unconstrained.

Given the time constraints, the apparent only true way to wrest the power away is to wrest him away. If he isn’t he has no stolen power.
