A federal judge on Wednesday overturned the state gay marriage ban in Montana, one of the last states to continue its legal fight despite rulings from appeals courts that oversee them that found gay and lesbian couples could wed.
U.S. District Judge Brian Morris ruled Montana's constitutional amendment limiting marriage to between a man and a woman violates the 14th Amendment's Equal Protection Clause.
"This Court recognizes that not everyone will celebrate this outcome," Morris wrote. "This decision overturns a Montana Constitutional amendment approved by the voters of Montana. Yet the United States Constitution exists to protect disfavored minorities from the will of the majority."
The clerk of district court in Montana's most populous county, Yellowstone, said she expects her office to start issuing marriage licenses to same-sex couples Thursday morning.
"We're ready to go," Kristie Lee Boelter said. "For my office, nothing will be different than any other day."
Also Thursday, the ACLU is planning celebrations . . .

It is the states that created the federal government and therefore should be telling it what it can and cannot do. And not vice versa.
There’s no such language in the US Constitution of course, much less it “existing” for such a purpose.

If gay people and straight people all have the right to marry unmarried adults of the opposite sex who are not close relatives, that is equal protection. Any other ruling is outside the constitution and illegitimate.

Well, it’s sad that activists felt they had to re-engineer a social institution in an unprecedentedly twisted way. Likening this to cross-cultural or cross-racial marriage is ludicrous. The hate is coming from the advocates of such arrangements, not from those who protest their being lent dignity by the state.
Once again, the rights, and the will of the VOTERS, are overturned by ONE judge.
Legislation from the bench. As anti-American as you can get. Wonder how much money this criminal hack made of this deal ??

What happens if the states refuse to obey the ruling from a leftist judge? After all, our Dear Leader picks and chooses which laws and rulings he will observe. It shouldn’t be any different for the states to do the same. Tell them to stick it -

Another illegitimate legalistic fraud perpetuated by a judicial branch usurping the legislative branch’s function and violating the principle of popular sovereignty.
The president would send in federal troops to enforce the ruling.
He should at least be forced to.
