Rep. Luis Gutierrez Thinks Obama Will Mandate 5-10 Year Residency on Immigration Order

Rep. Luis Gutierrez (D-Ill.), who leads the Immigration Task Force in the Congressional Hispanic Caucus, offered some clues as to what could be in President Obama’s executive order.

“I think the president is going to choose between five and 10 years, that is that you have to be in the United States for five to 10 years and you have to be working here and you are going to pay for a background check,” Gutierrez said on Fox last night. “You’re going to submit your fingerprints and they come back clear. He is going to give you a work authorization for two years and a Social Security card. He’s going to put you on the books paying taxes. And I think he is going to include that before you submit for an application you have roots in America. And I think that’s what he is going to do.”

“But that’s only going to be part. That’s going to be the largest part what he does in the number of people that’s about three million people. But I think what he’s going to do — even he’s going to do stuff for agricultural, farmers in this country, they need a million.”

Gutierrez said “there is no citizenship” in the plan.

“The president has no authority. Only through an act of Congress can they ever be granted citizenship,” he said. “Think of it this way. Here is how I look at it, like is he going to set them aside and say ‘I’m not going to prosecute these people, I’m not going after them so I get to — so I can go after the really bad guys and use the power of the government, the deportations will continue, but go after another.’”

Gutierrez said they won’t be able to sign up for welfare, food stamps and other federal benefits.

“And they can’t get a Pell grant to go to college. They cannot. Obviously we are raising money in our own community to help them, but from private sector,” the congressman said. “No, there won’t be any government benefits. And I just want to make clear to the American public — even the background check, they have to pay. The processing of their documentation, in order to get that work permit, probably will be around $500. There cannot be a cent of tax dollar money used even in granting them the work authorization. They must pay for it out of their pocket.”

He estimated four to five months from the period of Obama’s announcement to when illegal immigrants can start applying for legal status under the order.

Gutierrez suggested locking Rep. Trey Gowdy (R-S.C.) and Sen. Chuck Schumer (D-N.Y.) in a room together until they arrive at a compromise immigration bill. “Let them come back in 45 days,” he said.

“They control the House. They control the Senate,” he said of Republicans in the next Congress. “Tell them to stop whining. Get the legislation done and put it on the president’s desk. That will stop everything.”

What are they going to do when the “prove their residency by offering up forged papers? Since the people who rush through applications for residency and citizenship ignore little things like criminal records why should we believe it will be any different when they put this into force?

Have they overturned Obama's 2012 DACA Dreamer amnesty that has legalized 580,000 so far?

Amnesty is forever. It won't be overturned by the courts.

Not really.

I’m looking at it along the lines of how the Clinton assault weapons ban was allowed to sunset, with no negative impact to the Republicans.

If, again, what Guiterrez says is true, this is time-limited. It doesn’t require Democrats to be truthful, in fact (like the implementation of Obamacare) takes advantage of their lies and allows inertia to run it’s course in exposing those lies for what they are.

Now here’s a possible kicker ... If I were running dirty tricks for a Conservative organization I’d start pointing out to the Hispanic community that this thing is time-limited, and when it does sunset in a few years DHS will convieniently have all sorts of data on the illegal registrants that can be used to find them and arrest them for deportation.

If I were tricking for conservatives I’d do what the Virginia Voters’ Alliance is doing by poring over jury duty exemptions due to non-citizenship, then finding those people having voted, and going after them. $10K fine and a little time for vote fraud.

I’d make it real clear to the illegals that they better not have voted illegally if they’re going to apply for this program.

Bambi isn’t authorized to create law. The Constitution explicitly authorizes CONGRESS for that function.

Obama’s EO might make him feel important, but it isn’t LAW.

PERIOD. FULL STOP. END OF STORY.

It sunsets by default. Means that Obamas successor gets to renew it by EO, or has to go to Congress to make it permanent.

There’s no way, I think, that a Republican president goes the EO route. Even a Bush or a Christie (God forbid). If there’s a big enough backlash (as I think likely) I don’t see a President Hillary doing it either.

Going the Congressional route will require a 60 vote supermajority in the Senate. With Cruz, Lee, Sessions and now Ernest and the other pro-tea party Class of 2014ers I don’t see that as likely either.

Instead there’ll be the kind of paralytical infighting that has prevented both Obama and before him Bush from getting something through. Which is actually a good thing because the amnesty just expires by default without the ability to blame anyone for actively killing it.

I'll believe that when flocks of flying pigs blot out the noonday sun.

Non-citizens are also not supposed to vote...yet many thousands (at least) voted because they registered to vote under the motor-voter law.

And, of course, none of these people will (continue to) commit fraud...again, cut to the scene of the flocks of flying pigs if you believe that.

To think my family had to pay several thousand in legal fees, wait a year, pay DHS fees, wait, and finally get accepted.

Break the law and get rewarded.

Exactly what my wife had to do (which really means that I footed the bill). We literally spent a couple days of our time on line, in freezing weather in Newark, NJ, and did all the rest (including several thousand in legal and INS fees) to do things the right way. Wife wants to sue the government to get the money back...I concur, but know that nothing like that will ever come to pass.

This is, among many other things, a complete slap in the face to every legal immigrant and their family. Yet, many are in favor for tribal reasons (kind of like many blacks reflexively back Obama, despite him destroying their opportunities to prosper).

FYI, my wife is a citizen and doesn't vote for the Jackass Party.
