New Texas Bill Would Ban Enforcement of Federal Gun Control

"AUSTIN, Tx., November 13, 2014 – A Texas state representative has introduced a bill to thwart enforcement of virtually all federal gun control measures within the state.

Introduced by newly re-elected Representative Tim Kleinschmidt (R-Lexington), House Bill 176 (HB176) declares all federal restrictions on the right to keep and bear arms to be “invalid” and “not enforceable” within the state of Texas. It reads, in part:

A federal law, including a statute, an executive, administrative, or court order, or a rule, that infringes on a law-abiding citizen’s right to keep and bear arms under the Second Amendment to the United States Constitution or Section 23, Article I, Texas Constitution, is invalid and not enforceable in this state..."

If this bill were to become law, it could overturn the National Firearms Act, the Gun Control Act, and the 922(o) Machine Gun Ban for weapons made and kept within the state.

Except that it doesn't say it applies only to weapons manufactured and kept in the state, so it has zero chance of surviving the court challenges. Which Kleinschmidt should know.

Liberals (and libertarians) have been for the decriminalization of weed for a long tine. However, liberals HATE guns and you can bet Obama will send the JBTs to come down hard on anyone who take the Texas law on its face value.

Yes, but the fed stil can regulate, except for guns made in montana that are owed my people in montana

Actually, its in the bill. Section 2 (5) reads in part “...Although the states
have granted supremacy to laws and treaties made pursuant to the
powers granted in the constitution, that supremacy does not extend
to various federal statutes, executive orders, administrative
orders, court orders, rules, regulations, and other actions that
restrict or prohibit the manufacture, ownership, and use of
firearms, firearm accessories, or firearm ammunition exclusively
within the borders of Texas...”
