New Texas Bill Would Ban Enforcement of Federal Gun Control

"AUSTIN, Tx., November 13, 2014 – A Texas state representative has introduced a bill to thwart enforcement of virtually all federal gun control measures within the state.

Introduced by newly re-elected Representative Tim Kleinschmidt (R-Lexington), House Bill 176 (HB176) declares all federal restrictions on the right to keep and bear arms to be “invalid” and “not enforceable” within the state of Texas. It reads, in part:

A federal law, including a statute, an executive, administrative, or court order, or a rule, that infringes on a law-abiding citizen’s right to keep and bear arms under the Second Amendment to the United States Constitution or Section 23, Article I, Texas Constitution, is invalid and not enforceable in this state..."

If this bill were to become law, it could overturn the National Firearms Act, the Gun Control Act, and the 922(o) Machine Gun Ban for weapons made and kept within the state. Lets get this done!

Finally, someone actually pushes gun rights the way it out to be pushed.

The lack of this sort of thing turned me off to the NRA years ago.

The question is this: Will the state of Texas come to your defense when the feds arrest you for violating a federal gun law?

It only really has effect when the resist the enforcement of federal gun laws within the state.
This would involve the arrest and incarceration of any fed agents attempting to enforce them.

Other states have created laws like this? Have they been challenged? It seems like I remember Montana’s being ‘overturned’ by an activist judge.

Don’t know, but Colorado has had legal weed for a while now, and the Feds haven’t done jack squat to stop them! If this passes into law, I expect the state to tell the Feds to eat shite.

Here’s a question: will this apply to the military installations which have concurrent jurisdiction with the state and those which have ceded jurisdiction to the state? If so, I will finally have the ability to carry on-base the weapon I carry 98% of the time off-base.

I have no clue man, I’m not the author of this bill. But I would imagine that a federal base retains federal restrictions. A National Guard base might be different.
