Supreme Court lifts hold on gay marriage in Kansas

WASHINGTON (AP) -

The U.S. Supreme Court said Wednesday that same-sex marriages can go ahead in Kansas.

The nation's highest court denied the state's request to prevent gay and lesbian couples from marrying while Kansas fights the issue in court. The state constitution includes a provision banning gay marriage, approved overwhelmingly by voters in 2005.

I suspect that Roberts and Alito didn’t disent because then it would make it look like the full court has already decided on the merits of the case.
I know that is weak and certainly not what I would have done.
But if you aren’t going to get the stay, and you want Kennedy to keep an open mind about it, then it makes some sense from a long term strategic standpoint.
But overall its gravely disappointing that there aren’t five justices to put the brakes on this issue until it can fully hear the cases and resolve the circuit splits.
Right now what we really need is open and absolute defiance by the state’s.
Force a showdown so the SCOTUS will see that they should think about how irrelevant they will look should they rule in favor of gay marriage and try to impose it on the whole nation.
If now isn’t the time to resist then when?

Can’t we just get rid of the IRS and the progressive income tax system and all this goes away? Doesn’t that take away all the incentives for same-sex marriage?

I would like to see us get rid of all taxes and replace them with on value-added tax on manufacturing and a higher VAT tax on manufactured imports. That would give home-grown manufacturers an advantage to stay here and keep jobs in the USA. That would mean all taxes would be baked in to products you buy and individual Americans would not have to worry about a tax arm of the government or taking any advantages of a income tax system like filing single, married, harem, claiming # of dependents or goats, sheep, etc, lol. Plus, let the governments at all levels be limited and live within their means like the Constitution is supposed to be.

What was the point of the stay? Just to toy with Kansas?

Only to apply a fake facade of "thoughtfulness" to the process. Actually, there is absolutely NO careful jurisprudence involved anymore.

Remember when courts first started overturning the definition of marriage? They put in place a period of MONTHS to allow state officials to either appeal, or get their document systems in order to try to accommodate the new paradigm. Now, all carefulness has been chucked out the window.

What documents are these states even using for marriage license applications? The modified documents must be fraudulent because they are not state approved.

10 years go people were operating under the evidently insane presumption that the Federal Employees in black robes would uphold the Federal Constitution rather than betray it by usurping every non-enumerated authority to themselves and their appointing masters.

Its time we demand the abolition of the Federal INJUSTICE system. We who put our faith in the hands of a universally corruptly faithless and self-serving set of men have been proven beyond any shadow of a doubt to be foolish in that presumption.

The Federal Constitution is Dead, We are now in direr need for a revolution. I say when the dust settles there should be at 7 heads rolling down the steps of that new symbol in Washington of imperial and very much hypocritical injustice.

Now they have been exposed as the liars and trickster they are. We will have a majority in Congress and majorities in state legislatures. Actually this is a PERFECT time.”

Indeed as a political party we now have the power in our States to begin the process of dismantling the Federal injustice system. We should ask our congressmen to uses every means at their disposal to defend and cripple any effort to stop us.

Traitors to law and liberty now sit upon the Federal bench in commanding numbers. There can be no freedom under theses lawless despots and thus until they are gone no peace.

“Time for a Federal Marriage Amendment.”

Until the Federal injustice system becomes inclined to actually read the Federal Constitution Its hard to imagine us getting very far adding more text to it. Unless of course that text implicitly empowers and demands a separate party throw those injustice out.

I agree no good christian or lover of law can afford to ever give up on this matter that dictates the future of family.

But i do not see the lawless federal injustice system yielding to the clearly expressed constitutional consent of the governed no mater how many times we add to that.

We need to destroy the Federal injustice system, The Federal employees in black robes must be for the most part made jobless and tossed into the very sinful sodomite pit they would force us to live in.

The first step is striping from them their authority and any decent man’s respect for their edicts. From here on out let it be said that Good men only fears their tyrannical power and no man should respect them here on out.

It is on their lawless backs that 40 million of our country men are already dead, millions more due to die(row vs Wade), and still the rest of us forced to participate in sinful behavior.

Well I say No, and theses injustices who have taken the form and power of TYRANTS must be removed by any means possible!

That may or may not be true, one way or the other it really doesn’t matter. People are scared even speaking out against this evil has cost people their jobs and opposites because our enemy is evil and completely intolerant of different opinions. Even if those opinions were near universal just a decade ago.

Sodomy is not marriage, and it never will be no matter what the courts or participants might choose to call it, and insist we treat it as. It is a sinful relationship and self-destructive act that can lead only to disease and injury. Theses are the facts of sickness as well as the true laws of God and they will never change no matter how unpopular they might become in the repressive ideology of some tyrannical men.

What we can say of marriage is that it must by nature of practice & understanding be dead among those who believe the Federal court’s definition. Their wives & husbands can be regarded open game, much as they are already open in heart and mind.

That does not however mean that marriage is dead among those who are still committed to its historic family based definition & function. For them alone where marriage still lives in their hearts and minds it exists as that Convent with God, unbroken and defended if not by state then by the man and woman among whom it really matters.

One thing this sordid, pathetic, degraded mess proves: there is a need for an amendment to check the power of the judicial branch of government. If judges are going to legislate from the bench, then they should be subject to the same checks as the actual legislative branch- they should be elected, serve only a limited of term of office, and should be subject to recall by the voters. Power in our system is supposed to flow from the people to the government, and overturning a vote of the people of a state using some legalistic flimflam is a corruption of that system. Even fiscons who could care less if civilization dies (as long as the checkbook balances) need to pay attention this matter.

I keep saying it is over. Sorry to be so negative but I can see no good coming out of the SCOTUS, the Admin, or the GOP run Congress during the next two years and you all know why in each of those three cases. OR you should understand why.
