Flag flap: Indiana veteran, wife battle homeowners association over Old Glory

An elderly veteran and his wife say there’s “absolutely no way” the flagpole outside their Indiana home is coming down, despite threats from a homeowners association — and a local prosecutor intends to back them in court if necessary.

Bob and Judy Willits insist they intend to fight multiple letters from the Fieldstone Homeowners Association regarding the American and POW/MIA flags outside their Greenfield home. The couple was first told in early September that the freestanding patriotic display wasn’t welcome since it wasn’t mounted to the home.

“We have absolutely no plans to take it down,” Judy Willits told FoxNews.com on Tuesday. “It would be kind of a bloody situation if we had to take the flag down at this point.”

Huh? Ya want more .Gov authority over private property rights?

The prosecutor should be run out of town.

Pretty cut and dry. If you 'own' the property. Display the flag how ya want.

Although, I did once rent a house in an HOA-infested subdivision.

The president of the HOA was a petty little tyrant.

We did not hit it off very well.

He did not like to have his “authority” challenged.

I challenged his authority on a regular basis (ONLY in response to his ridiculous demands and complaints though)

It was a lot of fun for me.

Not so much for him.

When I moved away, he actually dropped by “to see me off” (translation: “to make sure that trouble-making bastard is really leaving”).

If their problem is that the pole isn’t part of the house, a couple of 2x4’s and some C clamps should remedy that.

It has absolutely NOTHING to do with MORE government authority over property, and I have NO idea what you are ranting about.

Not a rant. But, are you suggesting there should be a Federal or local ‘Display the American Flag Act of 2005’? And the HOA should be in compliance of such ‘regulations’?

I used to back the rules of the HOA on a lot of these but if this old guy wants to fly his flags...

....then he can do so by mounting it to the front of the house as the HOA rules allow.

That's what I've done......

A person who buys a property should not have to join the HOA, it should be a choice.

There already IS a "Flag Act of 2005" in that locality.

The purpose of the ordinance, as described by said prosecutor, is to prevent HOAs from banning the display of the U.S. flag by property owners.

It is clear you did not read the article.

I’ll never understand why anyone would move into a HOA community

It keeps the riff raff out. You know, those nasty people who choose not to keep up their yards, put their dog outside on a leash and let it bark for a half hour till they finally bring it in, leave their broken down cars on the street until they either sell it or fix it.

I own a house in what's called a "detached condo" complex and see absolutely nothing wrong with our HOA......It is what it is I guess. You either like them or you don't.

The person who originally built the properties has that right to make that determination.

membership is determined then and required by title.

Letting properties opt out over time undermines the community established during the original development and is impractical to change in a number of ways.

Don’t buy there.

The HOA is the owner. Secondly, the prosecutor brought up the ‘Freedom to Display the American Flag Act of 2005’, a Federal Bill, nothing local about it. Property rights be dammed.

wasn’t there a thread here a few months back. A high court decision that hoa could not ban US flags.

However, if you’re in a condo, everything outside the balcony, deck, walls is common area and under the HOA. They can probably ban flag poles and flags or anything else in the common area. Not my idea, but I think that’s the legalities of it.
