Police repeatedly mistake Pennsylvania man for suspected cop killer Eric Frein
Fox News ^ | October 23,2014

Friends and strangers are rallying to help a man whom police have repeatedly mistaken for Eric Frein

James Tully, who doesn't own a car and who walks 5 miles to work every day, has been mistaken for Frein more than 20 times by heavily-armed law enforcement scouring the Pocono mountain region for Frein,

On at least one occasion, Tully, 39, claims he was forced to the ground and had a rifle pointed at his head by an officer as he walked to his job along a heavily wooded road near where Frein is believed to be hiding, according to the Pocono Record. After Tully left work Friday night, he told the newspaper he was stopped by a driver dressed in camouflage and a tactical vest and holding a rifle.

"The only ID I saw was the barrel of the gun," Tully told the paper. "He yelled at me to get down on the ground with my arms out wide and he demanded my name."

Tully said the man ripped the lanyard from around his neck as he drove his knee into his back.

"I will break you right here. What is your name?" Tully quoted the man as saying, according to the Pocono Record. "From the minute I saw him with that gun I thought, let me survive this."

Tully says he was not released until a state trooper showed up and told the officer that he was telling the truth. Tully limped the rest of the way home, according to the newspaper.

Shortly after the encounter, Tully had trouble and was taken to the hospital, where doctors told him his ribs are bruised as a result of the incident. He told the paper he hopes the police will pay for X-rays and time he was absent from work.

I wonder if they would leave him alone if he was riding a bicycle. Also, what kind of incompetent morons stop THE SAME wrong guy more than once?

That can’t apply at the arrest stage, regardless. All that’s necessary to support an arrest is probable cause. The police are supposed to use no more force than is necessary to effect the arrest, or stop, or whatever. If this guy submitted, there is no justification for the knee in the back, bruised ribs, etc.

“He’s lucky they didn’t follow him home a shoot his dog.”

He’s lucky they didn’t just light him up like LAPD did with those Latina newspaper deliverers, when they were looking for Dorner.

Organizations, like mobs (and police are no different) are only as smart as their stupidest member.

Unfortunately, the police are highly armed.

He told the paper he hopes the police will pay for X-rays and time he was absent from work.

He's have to sue the government entity at his own expense and probably have the case dismissed.

I surprised they did take him to the nearest animal shelter and force him to adopted a dog and then shoot it.

There’s a guy around here used to wear felt moose antlers as he walked to work.

If he did that in rural PA, he’d be going home across the hood of someone’s car.

I see this manhunt on the news every night. If you could see some of the footage it would blow your mind. Most of the police must weigh close to 300 lbs and most likely haven’t been out of the cruiser on foot for a long time.

I swear they are the rejects the Marines tossed aside and this is as close to a war zone they will ever get.

We Pennsylvanians are getting tired of footing the 2 million plus dollar bill every week for on the job training.

Hell I saw a news footage where the police were looking out over a bridge sitting on their asses with the tactical weapon sitting on the rail of the bridge a foot away from the operator.

"I will break you right here. What is your name?" Tully quoted the man as saying,

That should have been that guy's last day as a cop.

Unidentified PA Cop: Pull over!

Unidentified PA Cop: Yeah, well are you aware that it's against the law to impersonate a felon here in the state of Pennsylvania? Come on, give me that ID, you little pumpkin pie, hair-cutted freak, come on!

PA Man: But I'm not impersonating anyone, officer!

Unidentified PA Cop: You keep your mouth shut if you know it's good for ya, buddy! Get down on the ground! What's your real name?

PA Man gives him his ID. Cop puts a gun up to his head and smacks him around a bit until a PA state trooper stops him and explains who he is.

Unidentified PA Cop: Get the hell out of here!

Yep. A reasonable guy might give them two freebies. If the goon squad can’t spread the word after that sue them so hard they have to sell their jackboots on ebay.

It would be time to call the FBI, I’d figure. For whatever good it still is.

It’d be nice if police actually paid for their own crap when they lose a lawsuit over things such as this, rather than the taxpayers getting shafted.

Deputy Lester: [referring to the mistreatment of James Tully] I was just talking to Mitch, and he said that Gault and a couple of the deputies were... a little hard on the guy.

State Police Capt. Dave Kern: Assholes!

Teasle: It doesn't make one goddamn bit of difference, Dave, and you know it! If one of my deputies... gets out of line with a civilian then the civilian comes to me with it. And if I find out it's like he says I kick the deputy's ass! *Me*! The *Law*! People start f#cking around with the law then all hell breaks loose! Whatever possessed God in heaven to make a man like James Tully?

Tully's mom: God didn't make James, I made him!
