GA woman mistakenly jailed for more than a month after cops confused SpaghettiOs for meth

A Georgia woman was mistakenly jailed for one month after cops confused her SpaghettiOs for meth.

Ashley Gabrielle Huff was first detained on July 2 after officers in Gainesville found a spoon with a dried substance baked onto it inside her car during a routine traffic stop.

The 23-year-old, from Commerce, claimed it was residue from the canned pasta that she liked to eat in the vehicle.

Police, however, believed it to be methamphetamine.

Huff, who had no criminal history, was sent to Hall County Jail for two days so cops could conduct crime lab tests on the mysterious texture.

I apologize if I misunderstood your posting: “The mug shot explains why they thought it was meth”. I got the impression that you thought her expression justified the police action. Mea culpa.

4th Amendment...illegal search and seizure. Wow...I guess I better be careful with that cream on my coffee spoon.

I don’t doubt that you have days when you’re tired, and it shows. A person can’t lead a productive life without having days like that.

This is different. This is not just being tired.

If you google faces of meth, you’ll see mugshots of meth addicts from their first arrest, to later arrests. Even in the first mugshots, youll see facial abrasions, dirty hair, and difficulty controlling facial muscles. This is what I see when I look at this woman.

As I’ve been saying all along, I don’t believe she should have been arrested for looking like a meth addict, but I don’t believe she was.

Go ahead and hit it Laz. But it does have greasy hair like Debbie Washerwoman Shultz, abrasions on its face (and I don’t mean those adorable freckles), and an unnatural expression which suggests difficulty controlling its facial muscles.

I wasn’t aware that the pipe wasn’t entered into evidence. I wonder why that fact wasn’t mentioned by the many journalists who have written sappy sad stories about this innocent girl being framed by the cops. You’d think they would have mentioned that the pipe the cop claimed to find in her purse disappeared before being tagged as evidence.

My Jack Russell was so upset by it all that he barfed once we got the door opened. He knew something was wrong. I think the strangers trying to get in the truck upset him the most.

Conversely, you'd think an easy charge would have been made (GA § 16-13-32.2 - Possession and use of drug related objects)

These sort of charges are good 'plea bait'. Hit them with a dozen charges, then hope they plea to one of them, and you can let the others drop.

The fact she was not charged with this, tells me there was no glass pipe.

Gainesville is kinda close to Athens...

Draw your own conclusions about that, but, that little college there does produce some whacked out characters.

Maybe, but she looks better than I and my friends looked after a weekend of hard partying when I was 23.

Given the very mild quality of the contusion and abrasion coupled with her very fair complexion, I would guess they came from an officer putting his hand over head as she was pushed into the back seat of a squad car. It wouldn't take much for her to bruise. My guess is the steel bracelets probably also left some nice marks.

Same thing with the hair: I lived a few years ago in a semi-rural part of Indiana where abuse of hair product was a constant among young, working class white women. If it were greasy, it would shiny and flat on her head, but it isn't.

I have also known some alcoholics and drug addicts, and she doesn't look at all that way to me: no sallow complexion, no deep bags under the eyes from lack of sleep.

I suppose our experiences must just lead us to different judgments, but from the (few) details in the report, the whole thing smells like another bogus "traffic violation" fishing expedition.

Maybe there wasn’t. And maybe the abrasions on her face are from the cops beating her up. And maybe the cops lied about everything that you can’t see in the picture. And maybe her mugshot was photoshopped to make it look like she had abrasions, greasy hair and a spastic face. And maybe the cops had reason to investigate her and lock her up pending the results. And maybe when she presented in front of the judge, she appeared to need drug rehab. And maybe she didn’t. Maybe the judge ordered drug rehab just to be mean, knowing full well that she was innocent. After all, the cop claimed she had a glass pipe, but he couldn’t produce it for evidence.

A male nurse I knew at a nursing home I worked at in Knoxville could open just about any car in a matter of seconds. I worked in maintenance and usually we had to try to open locked out cars. When he was working we called him. LOL. His family owned a junk yard & he knew just where to catch the rod at.

Nice post and thanks for the link. I really liked this part of the story:

the result of a traffic stop for a tag light violation

I mean, I can smell the BS from here. The cop saw a beater car (1994 Explorer) with some young people in it, and thought "there must be drugs."

Since she was a passenger, what right did he have to search her bag?

And of course, regardless of being illegally searched, charged and jailed, she loses her job:

As a result of the incarcerations, she missed her kids’ birthdays and lost her job at Waffle House. She said she has been seeking legal counsel.

She's lucky she wasn't carrying the rent money with her, or they would have stolen that, too, under 'civil forfeiture'.

I'm so glad we live in a free country./s

Not involving any illegal drugs, nor anything else illegal.

Therein lies my question...How long does it take to test Spaghetti-O residue to determine if it is meth or not. I have a feeling somebody dragged their feet in an effort to enhance this woman’s experience with law enforcement...

Doesn't it suck to be called-up-short, point by point? :) I understand your need to defend with snarky sarcasm, when you are losing on both the facts and the law, pound the table, right? :)

After all, the cop claimed she had a glass pipe, but he couldn’t produce it for evidence.

Nor did he even charge her with said violation of law; I'd say this is the most interesting of all the observations surrounding this case.
