McDaniel cites Gunn’s challenge in his attempt to overturn loss to Cochran

JACKSON — Unsuccessful tea party-backed candidate Chris McDaniel is invoking a big Mississippi political name as he tries to revive his challenge in a U.S. Senate race: state House Speaker Philip Gunn.

McDaniel lost to six-term Sen. Thad Cochran in the June 24 Republican primary. Now, the state senator from Jones County is asking the Mississippi Supreme Court for a second chance on a lawsuit that seeks to overturn Cochran’s victory. Winning the legal argument could be difficult in a place with no history of judges ordering a do-over of a statewide election.

In a legal brief filed late Thursday, McDaniel noted that Gunn waited 34 days to challenge a 2003 Republican primary loss to incumbent state Rep. Jep Barbour. Gunn won the court challenge and the election, and he became speaker of the 122-member House in early 2012.

However, in McDaniel’s case, a judge said the candidate failed to meet a 20-day deadline to challenge the loss in a multi-county primary. McDaniel started his challenge 41 days after the primary. Judge Hollis McGehee dismissed McDaniel’s lawsuit.

Cochran’s attorneys said in Jones County Circuit Court last month that the Gunn challenge is not relevant to McDaniel’s case because the timing of Gunn’s filing was not argued as an issue in the court case that became known as Barbour v. Gunn.

Well, what do you know. A precedent, not from 1959 but within the last ten years (and again, involving the Barbour family!!)!

I hope McDaniel is successful. Cochran may well cause the Republicans to lose the Senate again. He and his cronies need to go away.

McDaniel doesn't win this challenge, with a decision soon enough so he can campaign to win, the US Senate is gone for the 'pubs.

This outrage was the "bridge too far" for constitutional conservatives. It's open warfare by the RINO establishment against their base.

I don't know how the polling looks in MS., but I think you can see the disgust of conservatives in other places. Roberts in KS. is in trouble. McConnell will probably win, but he's not running away with it.

Rove last week wrote an article about how the Pubs might not win the Senate.

I think the GOPe drank too much of their own Kool-Aid. They figured they could beat up the base and we would still come out for them. I know I won't.

The beatings will continue until morale improves.

Good for you. If we let Rove, McConnell, Cochran and Barbour get away with what they did in MS, the Conservatives are done in the GOP.

The key thing to remember here, the essential difference between Tea Party Conservatives and the ‘moderate’ GOP Establishment, the prime distinguishing mark that separates the two is:

Tea Party candidates run on issues,

whereas,

GOP Establishment candidates use democrat tactics.

The outcome is NOT ‘may the best candidate win’. The outcome is ‘may the candidate who better lies and cheats win’. This latter outcome is standard thinking for democrats.

Democrat atrocities include but are not limited to:

* Large scale vote fraud in myriad forms
* Race-baiting
* Circulating outrageous lies about their opponents
* Controlling election officials to tilt election results
* Intimidation by union thugs

Cochran and Barbour are former democrats and switched to the GOP when they saw the South becoming republican under the Reagan Revolution. Now they are back at acting like democrats. They have no principle philosophy other than money and power to get more money from government.

Cochran and Barbour committed all of the above atrocities and more to secure a US Senate seat that will continue to serve as a federal money machine for themselves and their gangs. The Export-Import Bank is one example by which the Cochran and Barbour gangs skim tens of millions for themselves.

Even if McDaniel is not able to overcome the Mississippi political machine, his tenacity is good for us all.

If its Thad on the November ballot, he will beat the dem. After a century of crap dem politics, its unlikely non-holders people will vote dem.

Thank you. I didn't get to this point overnight. I was a GOP party member, worked in the local office, served as an election judge, and gave to the party. First, I stopped giving to the party and began giving only to candidates. Second, I asked to be taken off the membership lists. Finally, this election I told the local office stop calling I won't help out anymore.

It became crystal clear to me that the GOPe doesn't represent me when a majority of Pubs in Congress exempted themselves and their staffs from obamacare and thought it was okay that it should be imposed on me and my family.

I can only speak for me, but I haven’t moved an iota since all this broke. I still won’t vote for Cochran.

Well that’s at least three of us, I hope the rest of the McDaniel voters hold fast. The GOPe richly deserves this.
