Federal Appeals Court Strikes Down Virginia Same-Sex Marriage Ban

WASHINGTON — The 4th Circuit Court of Appeals held Monday that Virginia’s ban on same-sex couples’ marriages is unconstitutional. On a 2-1 vote, the appeals court joined the wave of court decisions declaring such bans unconstitutional. The decision, by Judge Henry Floyd acknowledged both the debate over such laws and, in the court’s view, the clear constitutional impediment to laws banning same-sex couples from marrying.

“We recognize that same-sex marriage makes some people deeply uncomfortable,” he wrote. “However, inertia and apprehension are not legitimate bases for denying same-sex couples due process and equal protection of the laws.”

The court’s opinion is not effective immediately. According to the court’s judgment in the case, the judgment will take effect after the mandate is issued in the case. The mandate, under the court’s rules, will be issued “7 days after expiration of the time to file a petition for rehearing expires, or 7 days after entry of an order denying a timely petition for panel rehearing, rehearing en banc, or motion for stay of mandate, whichever is later.”

Years ago they said they wanted ot be left alone. Then they said they wanted just civil unions, then marriage.
Now it’s teach homosexuality to little kids at schools.

They have been lying to the public about what they wanted for years and the ignorant masses amongst us just said oh well , and it doesn’t bother me it’s their private bedroom business. All of this while parks, like blue hills in MA were having to close because homosexuals were meeting up with other strangers to have sex , because they want to act like animals.

That’s a waste of time. Gay marriage is done as judicial and legal issue. The Supreme Court may not even need to rule again it looks like, although it might anyway just to make the point clear. Lawyers, elected or not, pretending otherwise just look stupid.

Constitutional change, which is to say political change, is the only way to reverse the legal outcome.

Yes it is, unless the Supreme Court or the en banc Fourth Circuit overturns. That's how Judicial Review works -- Congress writes the law, the President enforces them and the Courts interpret them. If you don't like how the Courts are interpreting law (and I don't either) push the President and Congress to confirm better judges. But refusing to obey court orders DOES violate the law and the whole principle of Constitutional government.

A key phrase and will allow any other kind of marriage despite being false.

Any man can marry any woman, any woman can marry any man. That is equal.

With this interpretation bigamy, poly, incestuous, and any other kind of ‘marriage’ will be legal.

Well then the ruling concerned Virginia, not NC. The attorney general should have said I will continue to support the WILL OF THE PEOPLE until the US Supreme Court tells me otherwise. He didn’t because he’s a spineless democrat, who takes his marching orders from the White House.

No, the people of state determine what the law is. If that was not the case why in the hell did they vote in 2012!!!

We have turned into a lawless society, where the whims of a unelected beaurocrats trump the will of the people. We might as well be living in the old Soviet Union. To hell with elections, they mean nothing. State after state with a democrat state Attorney general is having sodomite “marriage” forced on them, AFTER THEY HAVE VOTED AGAINST IT!

If that’s not a lawless society I don’t know what in the world it is.

Between the invasion taking place as we speak and the courts we are finished. Does anyone really see things improving? Our side is quickly becoming the minority and with minority status comes oblivion. Unless, of course, you are the right kind of minority.

They all are walking around as if they have been given a free pass, no conscience at all for the votes they make as Democrats...and People give me a hard time when I say the term “Christian Democrat” is a oxymoron

Where are the Christian leaders? Where were they starting in the late 60`s? Why didn`t they come out and say, if you call yourself a friend of Jesus you can not vote for pro choice/pro abortion candidates

Where are they now? Franklin Graham I guess would be one of the few on the right side, Tony Perkins, Dr Dobson

Is there anybody from the Catholic Church, I dont think so

It` long past the time for leaders to step up and say, Christians cant vote Democrat, or moderate Republican for that matter
