The only reason they’re defending this guy is because he’s an ex-cop.
The guy would have already been sentenced and in prison, were he a regular *citizen*, and not one of the King’s former officers.

I'm trying to imagine being in a movie theater and having a argument with another theater patron....Then shooting him to death in front of everyone, claiming self defense because he tossed some popcorn on me.

The officer was standing up when Reeves returned to the aisle. He didn’t see a firearm, nor did the Oulsons or Reeves’ wife. Reeves was polite when he squeezed past the officer and there was no hint of anger on Reeves’ part. I’m not ascribing anything to the officer other than what he observed directly. He did suggest that he was more observant than most.
Reeves’ politeness could have been learned behavior. IOW, perhaps he could have still been angry. In that case he was responding in accordance with his LEO training.
I’m not assigning any more value to the officer’s testimony other than he was being consciously observant.
I don’t know about the heavily trained. Many states have codified the right not to have to retreat before reacting to a threat. I’ve never heard of that in WV. You screw with someone, as in threaten their life, and you defend yourself. I don’t know of any incident of true self defense, that a prosecutor decided to go legal in this state.
I could be wrong, but the few incidents where charges were filed were situations in which there was reason to indict and try.

Answer me this: Have you ever had any stranger throw an object into your face? What would you believe would be the purpose of such an attack? This idiot wanted a response. He was begging for a response. He hoped to punish a man in his seventies with a severe beating at the very least.
Tell me, did the attacker commit a felony or not? Was the action of taking the ex-cops popcorn by force and flinging it at him a crime?
If somebody is willing to commit such a crime before witnesses, what would convince you that the crime was going to end with just the robbery and assault? Or was the attacker going to punch the old man into unconsciousness and leave the theater? How much of a reaction from the ex-cop would have generated just such a response?

Agreed. This is going to be an uphill argument. You would have to do a lot more than throw popcorn on me to get me to draw a weapon. Most people who CC will go to great lengths to avoid confrontation. Like move to another row in the theater which would have been the first thing that I would have thought of.
I think there is more to it than a little popcorn. The ex cop has a chip on his shoulder about authority. He still thinks he’s a cop. He still wants to tell people what to do.

BTW, there was no felony here and no jury would ever convict either one of a felony if all there had been was a common verbal dispute with pop corn being tossed.
People don't get convicted of felonies and or sent to state prison over minor disputes/arguments where no one was even injured. Only a lunatic judge would ever convict someone of a felony and send them to state prison over something like this.
The only felon here was older man who shot to death the totally unarmed younger man.
The shooter left the movie theater, got his gun out of the car, returned to the theater, and re-started the argument. He finally pushed, pushed, pushed until he got what he wanted. He got a reaction. Then shot the man.
Pre-meditated murder. Pathetic.
When carrying my weapon, I am the least likely to get into an altercation of any kind. Because of the responsibility of carrying. A legal and a moral responsibility.
This old cop wanted to shoot somebody. He did it with his wife sitting next to him. What an inexplicably horrible person.
There are probably 25,000 arguments and disputes per day between strangers in public, people flipping others off etc....Most end it by walking away, some even get physical to some extent.
Very few end with one party opening up and shooting to death an unarmed person in public. And the perpetrator usually has a violent history, who's been in the system, in the joint, on parole etc...
This was not an armed robbery or armed assault by any stretch of the imagination.
That's what I *speculated* when I first reviewed the story, after reading the shooter, prior to the shooting, had left his seat for a while, supposedly to speak with a manager.
And that is exactly what ya should do if your packing to defend. In fact, this is what everyone should do even if you're not.
Ya never know who you're dealing with in public, what their state of mind is etc.
I don't know what state you were trained in, and it might be a good personal policy to retreat when possible, but most states do not have a legal obligation to retreat from a deadly threat. Most states are Stand Your Ground states.
Even in those that aren't, the duty to retreat applied only as long as it can be done in safety.
Yes if I shot everyone who ticked me off in a public place I would have to reload every few minutes. :-)
