Alaska to sue Interior Department for road to reach medical aid
Washington Times ^ | April 7, 2014 | Valerie Richardson

Alaska Gov. Sean Parnell announced Monday that the state will sue the Obama administration to allow construction of a 10-mile road to give residents of a remote fishing village access to emergency medical flights at an all-weather airport.

Residents of King Cove, Alaska, were outraged in December when Interior Secretary Sally Jewell nixed a plan for a land swap that would have allowed the building of an unpaved road between the small town and the airport at Cold Bay.

...

Since Ms. Jewell rejected the land swap, which would have given the refuge 43,093 acres of state land and 13,300 acres of private land in exchange for 206 acres of federal land, King Cove has required eight emergency medical flights to Cold Bay, including five conducted by Coast Guard medevac.

Mr. Parnell said the lawsuit would be based on the Mining Act of 1866, which allows states to assert a right of way based on historic use. States must give 180 days’ notice before filing such a lawsuit, according to the governor’s press release.

Last month, a visibly agitated Sen. Lisa Murkowski, Alaska Republican, criticized Ms. Jewell for her decision and vowed to fight it at the Interior Department appropriations hearing, giving a nod to the late Sen. Ted Stevens, Alaska Republican.

“When Ted was really agitated and really going to let nothing stand in his way, he would wear his [Incredible] Hulk tie,” she said. “Today, I have a Hulk scarf on. And I don’t typically engage in much drama.”

Nineteen Alaskans have died attempting to fly out of King Cove, whose airstrip is frequently closed because of treacherous wind sheer.

Decimation:

Procedure
A cohort (roughly 480 soldiers) selected for punishment by decimation was divided into groups of ten; each group drew lots (Sortition), and the soldier on whom the lot fell was executed by his nine comrades, often by stoning or clubbing. The remaining soldiers were often given rations of barley instead of wheat (the latter being the standard soldier’s diet) for a few days, and required to camp outside the fortified security of the marching camp.[3]
Because the punishment fell by lot, all soldiers in the group were eligible for execution, regardless of the individual degree of fault, or rank and distinction, unless rigged to eliminate the mutiny ringleaders. The leadership was usually executed independently of the one in ten deaths of the rank and file

Wasn’t this the incident where Jewell went to the village to hear their petition, then told them “I’ve heard your story, but now I need to hear the animals”, and then ended up denying the road because it might affect some species of duck?

Solution:

Jewell should be dropped off out in the middle of the Alaskan wilderness. Maybe the ducks can help her survive and make it out.

Well, it was to aid in the search for survivors. And the landslide already did 300 acres of damage. But I was still impressed with the “get-er-done” nature.

I live in the Eastern Interior, 4 miles from border on the Yukon. Our road just opened last week, closed since Last October. We can get a life flight in from Fairbanks pretty quick, unlike out in south west. Unpopulated you say, me thinks too many people here already.

Actually, the Indians have pretty good clinics in every village and they see White People too.

Parnell ain't no Palin, but he stands up to the Feds every time.

Decimation is symbolic of dominance... but we don’t need any stinking symbols here. The government has tasked itself with almost an order of magnitude more duties than is right.

Push them out into the private world at the same time as giving the private world the benefits of smaller taxes and less regulation. They’ll be forced into productive things. They’ll complain but ultimately be glad they were wrenched out of their stupors.

Just build the road and tell the feds to pound sand

Of course. Going to court just gives some warped judge the chance to say "no".

“Just build the road and tell the feds to pound sand.”

Build it, and have the militia ready to do unto the feds as they tried to do unto Bundy. Dirty Harry and Incompetent Sally, who is no jewel, be damned to LDS hell and the fiery brimstone and nashing of teeth.
