HCSO: Houston area father kills boy he found in daughter's bedroom

Homicide investigators are gathering evidence after a father shoots and kills a teenage boy he found in his daughter's bedroom.

A spokesperson for the Harris County Sheriff's office said Deputy constables from pct 4 responded to a 911 call around 2:20 a.m. about a shooting in the Bridgestone Lake Subdivision in Northwest Harris County.

Castle doctrine would only apply if the kid broke in to the house, not if he was invited in. So the guy might be in trouble.

Nope. He would have had to have known at the time that the boy had been invited into the house in order for that to matter. Since the girl lied and said she didn't know the boy, that was the knowledge the dad had at the time of the incident.

The problem is, you don’t have a right to pull a gun on just anyone that happens to be in your home and give them orders to be obeyed at their mortal peril. There are rules as to when you have the right to do that, and when you don’t.

No. He dealt with what he perceived as an extant threat to himself and his family in a perfectly legal manner (in Texas).

Absolutely yes. And this is the sort of stupidity that can cause some of these justifiable self-defense laws to be changed.

1. The boy had been let into the home by the daughter. He was an invited guest.

2. The daughter lied to her father when by saying she did not even know the boy.

3. The father lost his head and ended up murdering the boy his daughter had let into their home, and into her bedroom.

4. And who thinks anyone can believe the story told by the father, that he "thought" the boy was reaching for something. About the weakest possible claim of self-defense. The father had no reason to shoot the boy, and he has no credibility as anyone to be believed, nor does the daughter. The poor judgement, lie and overreaction of the two resulted in the death of an innocent boy. Or maybe you think that every boy who's had sex with someone's daughter deserves to be shot.

This stupid scenario is not one to hold up as proof of the need for various self-defense laws. It's the opposite.

Surely there are SCORES of parents who make the same claim, and NEVER discover how many times they were “wrong” about well they thought they “knew” their children, and their friends.

You are correct, but only one of our daughters got pregnant before she was 18 (she was 17) and I had warned her about the boy but she was the one who knew more than her stupid old man.

Luckily, the bum is gone, she graduated on time, in the top 25% of her class and she has a beautiful four year old son! She works, is now in her own home and in life she learned a tough, hard lesson: listen to Daddy.

My two oldest daughters were NEVER allowed to have sleep overs without us at home - I knew them and their friends and wasn't going to take a chance, because I knew them and their friends. LOL!

“She is a minor child under the age of consent (17) and there is no exemption from prosecution even if both parties are under the age of consent.”

From the Texas Penal Code, section 22.011 on sexual assaults:

“(e) It is an affirmative defense to prosecution under Subsection (a)(2):

(1) that the actor was the spouse of the child at the time of the offense; or

(2) that:

(A) the actor was not more than three years older than the victim and at the time of the offense”

Protecting her from what? You don't know. Were they engaged in sex when the father came in? It doesn't say. Was the boy assaulting the girl? You have no idea if there was any reason for the father to think he was protecting her.

He had to have a reasonable belief that the boy was an intruder. It’s probably going to come down to whether the grand jury thinks that, under the circumstances, that would be a reasonable belief.

So you are equating a man having perfectly legal sexual relations with his wife to someone having sex with your underage, unmarried daughter?

1) You have no clue if that's how his daughter's conception occurred.
2) She's underage? So's he! So let's ensure his death!

Where are the Viking kitties when you need them? We seem to be infested with trolls on this thread.

I imagine the laws vary quite a bit from state to state. Where I live some guy walked down the long country drive and the husband in the garage noticed him. The husband asked him what he was doing - no answer. Just kept walking. Then the guy walked up onto the porch of the house, with the husband coming over from the garage to tell him to get off his porch.

The guy reached for the door handle to the house (with wife and kids inside), and the husband shot him in the back and killed him. Justifiable. Although I imagine that the deceased was a known crack head had something to do with it. Not sure what would have happened if it had been a hard-of-hearing salesman.

Not that that is comparable to the teen boy, but some states have a pretty low threshold for a justifiable homicide. I would like to think that I could tell if my 16-year old daughter was lying to me or not - but I imagine at 2:30 am and a daddy’s rage going that might be hard.

It IS sad for all involved, but if the facts are what the articles says, sounds justified.

Trust me, in Texas the fact that the boy was in the house, was unknown to the father and the daughter claimed he was unknown to her is all that the grand jury will need to hear. I agree it would be different if he had met the boy before, etc. But at least in Texas, it is perfectly reasonable to presume anyone in your house under the circumstances as described in the story is a threat.

Kudos to your daughter for achievements.

Many kids find that lesson out the hard way. MY own father, didn’t allow ‘sleep overs’ or ‘sleep outs’ at all....no matter who it was. He too, was a Marine. He was known as “General Buzzkill” in our household. LOL!
