Politically speaking there couldnt have been a better Supreme Court decision. If Obamacare had been declared unconstitutional, the Democrats campaign in November would have been those horrible Republicans have politicized the Supreme Court and denied affordable healthcare to everyone. The focus would be on the courts unfairness. The Democrats would have a plausible if unfair case (and in politics lack of fairness is a given). Advantage Democrats. Advantage because the last things they want to talk about are Obamacare and taxes. And thats the second big plus from this decision. The focus thanks to Justice Roberts is going to be on the biggest tax increase in human history on everyone, not just the rich. And on the lies of Obama which dwarf those of Clinton. Obama promised no tax hikes on the middle class and then defended Obamacare before the Supreme Court as . a tax.
As for the constitutionalists. Roberts argument makes sense to me. Yes the power to tax is the power to destroy, but its in the Constitution. So this decision doesnt really change anything constitutionally. If you dont like Obamacare, the remedy is to repeal it. Let the elections begin.
They think they are getting something for free. They have no idea what this will cost them personally.
Denying someone schadenfreude is almost as much fun as enjoying schadenfreude. Turning a smirk into a frown is just plain good wholesome fun. Enjoy!
I detest the notion that you have to lose to win. This is the old Republican practice of conceding bit by bit to win a crumb here and there. I am sick and tired of trying to spin a loss into a win. Stop it I say, stop it. You gave away more than you won. Roberts threw this case and we all know it. Just look at the dissenting opinion, which was drafted as the majority opinion before Roberts switched in the eleventh hour when Obama’s thugs delivered the ultimatum to roll over or “else.”
Robert Byrd and others objected to the reconciliation process, and so introduced the "Byrd Rule" to sharply limit what could be passed by reconciliation. The 'rats might try to invoke that if they are in the minority in the Senate and a bill comes up with a repeal provision. We'll have to see how it plays out, if such a thing comes about at all.
LOL
Under the government's boot? More like all of us will be working for the government. The IRS is going to need lots of people to shuffle through papers. Lawyers will be needed to write court orders, construction workers will be employed to build new gulags (Made in the USA!) and policemen and brownshirts will be kept busy escorting offenders to them. No worries, though, because all the workers will be able-bodied since the death panelists will have sent the unfit and elderly to the "hospital" for "treatment".
Obamacare is a BFT, not a BFD as Biden said.
For those who haven't been paying attention to the Senate races. This fall the Republicans have an outside chance to end up with 61 senates seats.
I saw Dick Morris lay out how it could happen on Hannity one night, and this is before yesterdays ruling.
We remember what happened in 2010,2012 will be 2010 squared.
Yes, Morris and Horowitz both agree on this. And I agree with them. People are mad as hell and this has energized the Tea Party and Middle Class Americans like nothing else could. The November 2012 Election might make the Mid-Term Election of 2010 look like a church picnic. And, we’re just warming up.
Through the budget reconciliation process, which cannot be filibustered. We need 51 votes.
I know you are aware that budget reconciliation has been on hold for over 1100 days. No budget from the Senate, no budget reconciliation which is one of the reasons for all of the financial shenanigans, there is no budget. Obama’s was struck down but it serves the dems in the Senate not to produce one.
“No budget from the Senate, no budget reconciliation”
That is why it is so important to win the senate. Then there will be a budget and the process will go forward.
Thanks for the clarification. Winning the Senate. Now there is a tough battle worth winning. Of course winning means plus ten to make up the for folks who inevitably switch parties in the eternal struggle for power and control.
I totally agree with your analysis. The stupid electorate are still out there voting and there is no guarantee Romney will win. There is no guarantee it will be overturned. They have the power they wanted. Do you really think they will let it go? Liars on both sides.
Most of the people in this country are clueless. The media will do their thing and trash Romney relentlessly until election day.
The Supremes giving more power to a man who already ignores the rule of law. Makes me sick.
I also think the Rinos who voted to put Sotomayor or Kagan on the court should be targeted for defeat. That would be Lamar Alexander (Sotomayor) in my state who is now supporting the assault on our energy policies. Am still waiting for his response as to how I will be able to pay my electric bill when rates are anticipated to rise 8X their current level.
As one with chronic illnesses whose health care will probably be rationed, there is no bright side to me.
Those of us who love freedom lost big time.
We'll have to wait - - see how the mess shakes out... Pray we win in the elections... I like what you said, sick - but the issue is painful and I don't have the 'consequences' figured out enough to know what to say ...
the government couldn't decide, in front of the Supreme Court, whether they were arguing a tax, a penalty, a mandate , or even “whatever”
Roberts defined for them exactly what it was they were trying to say, and wisely, even Solomonaically, avoided politicizing his office, his court....and the coming election with his decision.
As it now stands, the election will turn on the merits of the Bill and those that passed this tax increase. Not upon the partisan nature of the court and its decision-making-which for the Democrat Party, could have been the best outcome given the headwinds they face this fall.
Either the American People will Tea Party this election or not. Either way it will be an historic election-marking the “retaking” of the Republic from the Communist/socialists or acqiescence.
None of us have a Crystal Ball but getting worked up over something we have no control of isnt helpful.
If Obamacare was all or largely overturned Obama would be history. But I never expected that to happen, the personal mandate maybe. I always posted that overturning that was about 50-50% and would be 5-4.
Furthermore, I was never convinced that overturning the personal mandate alone would help things if the rest of the bill was left in place.
I agree with some of the smarter the liberals that overturning the medicaid mandate was more way important than the personal mandate to limit the damage of this bill.(I am happy about it/they are unhappy about it.) The medicaid mandate was going to bankrupt every state in the USA.
If Romney wins and Rs have control of both houses then Obama-care can be pulled apart assuming Republicans have the guts to do it,
I see David is looking for the same pony I am.
Yes....and the Dems are crying with joy at the bloody mess they received.
