At Sonia Sotomayor hearing, Republicans are surprisingly tough

Senate Republicans mounted a surprisingly tough attack to open Supreme Court nominee Sonia Sotomayor’s confirmation hearing Monday, with Sen. Jeff Sessions calling her belief in the importance of a judge’s personal background “shocking and offensive to me.”

“I will not vote for—no senator should vote for—an individual nominated by any president who believes it is acceptable for a judge to allow their own personal background, gender, prejudices, or sympathies to sway their decision in favor of, or against, parties before the court,” said Session (R-Ala.), the ranking member of the Senate Judiciary Committee.

While some had expected Republican senators to step gingerly around issues close to the nominee’s ethnicity, Sessions quickly took aim at Sotomayor over her ruling last year against a group of white firefighters who sued the city of New Haven, Conn. after it canceled a promotional exam because African American firefighters did not do well enough to be promoted.

“Judge Sotomayor has said that she accepts that her opinions, sympathies, and prejudices will affect her rulings. Could it be that her time as a leader of the Puerto Rican Legal Defense and Education Fund, a fine organization, provides a clue as to her decision against the firefighters?” Sessions said. “It seems to me that... Judge Sotomayor’s empathy for one group of firefighters turned out to be prejudice against the others.”

The comments by Sessions, along with other GOP senators, came as a bit of a surprise given the lack of suspense about the ultimate outcome for a judge likely to be installed as the first Hispanic woman on the U.S. Supreme Court.

I called my senators to urge a negative vote. It always feels futile, given that Casey and Specter are both waaaaaayyyyy to the left of center, but they need to hear from their constituents. It was hard to get through to their DC offices today. I suspect they’re getting a lot of calls.

Yet there will be enough RINOS that will vote for this racial activist “judge”, that will outweigh any GOP that still have a “clue”.

In September 2001, Judge Sonia Sotomayor, now a nominee to the U.S. Supreme Court, introduced Justice Antonin Scalia at a conference on legal ethics at Hofstra Law School in New York. Sotomayor repeated an often-told tale about a meeting between Justice Oliver Wendell Holmes and Judge Learned Hand, the leading legal minds in the early part of the 20th century. After lunch, Holmes started to drive off. Hand, realizing Holmes had left his umbrella, ran after him calling, “Do justice, Sir, do justice!” in that peculiar manner of speech a century ago. Holmes, hearing this, stopped his carriage, responding: “That is not my job. My job is to apply the law.” The quip illustrated the balancing act between morality and justice. Judges, to do their jobs well, she commented, need moral insight into understanding how to apply the law.

If she'd follow her own advice and ditch the "wise latina" crap she'd be fine.

For a liberal to call attention to this line of questioning/comment speaks volumes. It implies that Senate Republicans aren’t usually tough.

Something conservatives have been privy to for quite some time. Furthermore, Gerstein is trying to persuade readers into believing that the confirmation hearings are unbiased, and that the process by which Sotomayor’s approval(if confirmed) had been carried out would have been fairly and carefully scrutinized.

Another farce conservatives have been privy to for quite some time.

oh please.....they’ll cave. I still say 2 or 3 at least vote her out of committee and she gets 25 R-votes min on the floor. 30+ wouldn’t suprise me at all..
