Obama camp: Lawsuits by citizens are 'garbage'

More than a half-dozen legal challenges have been filed in federal and state courts demanding President-elect Barack Obama's decertification from ballots or seeking to halt elector meetings, claiming he has failed to prove his U.S. citizenship status. An Obama campaign spokeswoman told WND the complaints are unfounded. "All I can tell you is that it is just pure garbage," she said. "There have been several lawsuits, but they have been dismissed." WND is tracking the progress of many cases across the U.S., including the following: Ohio David M. Neal of Turtlecreek Township, Ohio, filed suit in Warren Common Pleas Court in October to force Ohio Secretary of State Jennifer Brunner to request documents from the Federal Elections Commission, the Democratic National Committee, the Ohio Democratic Party and Obama to show the presidential candidate was born in Hawaii, the Cincinnati Enquirer reported. I have two Chinese born children and both have state issued birth certificates which are “legit.”

It also states their actual country of origin...

We should start a "Draft Arnold" campaign just to force the issue.

Arnold could say something like he was born on the kitchen table in North Dakota, then when his parents went back to Austria, they got him a birth certificate because they goofed up and failed to get one from Zipdacoatup, North Dakota.

No, maybe not, ....he might win!!

Exactly. A Hawaiian birth cerificate could, until 1972, be granted to a person born elsewhere, as long as there were witnesses. Unless it states the place of birth was Hawaii...........

Yes, the Democrat Congress could just redefine "natural born" in law. But there would still be damage to Obama, because he would be shown up for all the world to see as a dishonest manipulator..

All freepers need to email and email their local talk show hosts to report on this whole birth certificate thing and toalert their listeners.. I've been hammering mine with no success. They bitch and moan about the coming BO dictatorship but won't help to spread the word that real patriots are trying to uphold the constitution. The more this is exposed the more success these patriots will have getting a leg on this. Hopefully Judge Thomas will help. We are governed by a bunch of spineless cowards.

I would think that defensively, it might be good for some Democrat to introduce legislation redefining "natural born" to include Obama, since the definition applied to him only very narrowly excludes him. Erase the part about his mother being a minor and all is legit, even if he was born overseas.

But underneath it all, I believe Obama's resistance is not about legitimacy to hold office, but rather some emabarrassment about his BC. His birth name may be something else, and he may not be the son of Barack Senior. That he's the son of Barack Senior may have been a family cover-up legend that has now gotten out of hand.

I don't know how else to explain why Obama refuses to clarify that which could be clarified in minutes. And that which other candidates (including John McCain), did not hesitate to clarify.

That's the question I find especially strange. The only witnesses that say she was pregnant are all Kenyans.

Bingo. This has hardly ever come up, and it makes me crazy. The State of Hawaii says he HAS a birth certificate. Period. They have specifically DECLINED TO STATE what is on it.

Any prosecution of Hawaii Governor Lingle for making a certified pronouncement to the person presiding over the Electoral College that Barry appears not to be, or is, in fact, not a natural-born US citizen would ultimately be dismissed. Certainly no 12 jurors will let her hang for that.

She could alternatively keep everthing under seal, and present the sealed record to Cheney, should he desire to unseal it within his authority at the Electoral College vote, to make whatever determination, on his own recognizance. ;-)

President of the Senate, Richard Cheney, presiding over the Electoral College has "what it takes" to require a full, immediate airing of the evidence, ultimately pronouncing Soetero inelligible. Arguably, given the inherent separation of powers, SCOTUS doesn't have the right to overturn such an determination. I don't think Cheney would do it without sufficient evidence that would withstand a SCOTUS review, should they nonetheless take it upon themselves. Beyond that, SCOTUS is probably quite reticent to overreach (again) its Constitutional authority.

I believe Cheney will have gotten the absolute best of advice in this regard.

This needs to happen.

For that information PhiKap we go to our correspondent in Hawaii John Kerry. John, why wouldn’t Obama provide his real birth certificate to rove he was born in the US?

From the lawyer's perspective, these suits really are garbage. Not in the substantive sense--citizens are in fact entitled to learn from their servants what their qualifications to serve are; but rather in the adjective or procedural sense.

It is the problem we tried to identify in June. The legal efforts here are from people who happen to be lawyers and admitted to the bar but who are not experienced or sophisticated in management of multi jurisdictional complex cases. These suits generally have not been done correctly.

We can pray that one of the poorly drafted cases will pick up some creative lawyer who can figure out how, in a timely manner, to get to a result.

I have been concerned about developing the kind of evidence I might want to use if I were the lawyer hired to manage a sophisticated attack with sufficient resources--that may be unnecessary. It may in fact turn out that this reaches an ultimate trier of fact on the proposition that here is all the hearsay and speculation; Obama has never responded; if he was really born in the US, it ought to be very easy for him to respond and from his failure to do so, we can draw the reasonable inference that he was in fact born in Kenya; therefore the Court will order him to do so.

I'm not holding my breath. I would prefer to run this with ten or fifteen million dollars in my trust account and enough legal support to do it right--I think I could beat him. So far, no one with a big enough checkbook has showed up.

Frankly, I strongly agree with you. Wouldn’t it be wonderful to wake up and find Obama wasn’t going to be president? I wonder how they’d handle that...give it to Biden? But the powers that be don’t have the guts, and for the reason I stated.

Thank you, Aurorales. Nothing was ever gained by not trying. I’m hopeful that something is going to be done to dig out the truth on this matter. If we fail, I will find a small amount of solice in knowing that we did try to protect the Constitution and our country. Those who didn’t care enough to help but rather preferred to give up without even trying, will bear the burden of “woulda, coulda, shoulda”.
